ebay return postage who pays?

Received an item not as described ( different colour and seller doesn't have the correct color in stock ) Return tracked postage will cost me £8 sellers told me i have to pay the return, so im down 8 quid because they sent the wrong colour item, This can't be right surely?
 
If it's a business seller, then they pay return post for item not as described (aka faulty). Suspect it's the same for private sellers, too.

Return postage charges

eBay returns works out the returns postage charges and automatically applies the correct charges.

Things to note:
- Business sellers are legally required to refund the original outbound postage regardless of why the buyer is returning it, under UK and Irish law. Return postage is only chargeable if the item is faulty or if you failed to tell the buyer before the purchase that they were responsible for returns costs for remorse reasons.
- If you specify in your listing that the buyer is responsible for return postage costs for remorse returns, you're only responsible for return postage if the item is faulty or not as described. Business sellers are still responsible for the refund of outbound postage costs even if a buyer is returning the item because they've changed their mind. If you don't mention who's responsible for return postage, you're legally required to pay.

2. ebay will supply a prepaid label unless the seller opted out.

Seller pays for item not as described for the return. Is this a business seller or private??
 
I purchased a wheel barrow tyre from ebay and was sent completely the wrong size to what was advertised. Went to an ebay dispute as the seller would not reply to any correspondence and I still had to pay for return postage!
 
I do think the rules have changed from before. I had to pay to send a fake item back once and I wouldnt get my postage back. To do so was going to cost almost as much as the facke item cost anyway.
 
I had to return something last month that was not as described. Seller ignored emails so went to Ebay dispute and I was given a prepaid label to print out to return item.
 
Yeah and as a seller in the last 6 months I was made by ebay to pay for the buyer to send the item back to me.

Was exactly the same for me, I paid and sent it back anyway just to not give the seller the satisfaction of selling me an incorrect item and getting away with it. I emailed ebay asking why I had to pay to send the item back as it was completely the wrong thing and got absolutely nothing back from them.
