Depends if they were a risk. If it was a pre existing condition that could have happened anytime then yeah punishment is needed but if it was a random accident I'm sure they feel bad enough as it is.

Don't know if doctors are allowed to inform dvla when liscense should be given up.

Nothing is ever random. There was a cause to his, he was in control and eye witnesses claim he was doing 60mph. Whatever the reason jail is needed, someone's lost a loved one over Christmas because of this chap.

Doctors are legally obliged to break the doctor/patient confidentiality agreement and inform the DVLA if they know a patient has a condition that prevents them being allowed to drive but they know the patient has not sacrificed their license. This most commonly occurs with seizures but can apply to any medical condition.
 
My Granddad had his license taken at age 86 after reversing into a car with an elderly woman inside. He managed to reverse up and on top of the car leaving the woman terrified. She was fine though and we all had a chortle at his expense but needless to say I think licenses should be revoked at 80.

I disagree entirely. My grandad hung up his boots at 85 and up until then he was perfectly able to drive. This is someone who had a 25 year career in the army and he routinely did 10+mile walks well into his 80's.

The only reason he quit was because some guy in a rental T-Boned him at a junction which did shake him up.

Ok maybe not random but if it was say a heart attack without previous history of any heart problems then it's random. It's not like they knew it was going to happen. Besides how does an eyewitness measure the speed? Unless they're following at the same speed they have no clue.

Fair point but how would a heart attack cause him to be doing 60mph in a 30.

Personally I don't know as I've never had one but I'm lead to believe they're incredibly painful and can cause a rigor style effect so it's possible the pain caused him to slam his foot down.

Another possibility is the eyewitness is exaggerating. Short of forensics or video of the incidence there's no way someone standing at the side of the road can say it was doing X mph.

Don't get me wrong if they knew they were ill and something like this could happen then throw the book at them.
 
Seems a bit random :confused:. Why 5? Would put a massive strain on the system testing everyone every 5 years. The way it is now works. Accidents will always happen. Forcing people to retest won't stop that.

Because every year would be too much and every 10 years would be too little (in my opinion). 5 is a happy medium where a degrading ability would be caught and it's also frequent enough to ensure people brush up on their Highway Code regularly.

The system would adapt.

The same way a blackout caused the driver of that bin lorry in Glasgow to accelerate out of control down the road. The Audi was probably an automatic, too, so with the accelerator applied it would continue to accelerate.

Calls for jail before the facts are available seem incredibly premature.

So then, he has a duty of care to stay fit and healthy and reducing the risks of these things happening. Otherwise if he lead a healthy life style it could be down to genes etc, which means if he's prone to heart attacks or heart disease why would he be driving at that age?

Reminds me of the time an old lady reversed into my nice new car at a supermarket car park and her excuse was 'I thought the spaxespace was empty' I promptly phoned the police, even though she was old.

Did the police have a word with you about wasting police time? There is no need to call the police to minor parking accidents where there is no injury.

No one said he collided doing 60. He shunted another car at 60, so his speed would have been reduced en route into the shop. He was originally seen loosing control doing around 60, then he shunted some cars before going into the coffee shop.

The woman said she didn't remember her insurance details, so I put on my heated seats and phoned the police. She failed to provide me with valid insurance details.
