I almost certainly have not been scammed on ebay, any ideas?

You don't know that. Seriously, you have absolutely no way whatsoever to know that for a fact.

But if you started off with £255 in your account and you're going to end up with £255 in your account (you will, because this is a pretty clean-cut situation, Paypal will side with you if he doesn't issue a refund), how has he 'scammed' you? The only difference is that you won't be the owner of a phone that you were expecting. You'll be no worse off than when you started.

I know you won't accept what most people in this thread are saying (you've already demonstrated that) so there's no point in carrying on this conversation really.

imagine if overclockers did that to you? Buy a graphics card as your old one broke.. borrowed the money for 10 days then told you that your not getting one..

Maybe he packaged it up all nice and tidy, took a walk to his front door in order to visit the post office in a prompt manner to fulfill his burning obligations as a seller, and then promptly dropped it down the stairs. Made up the Royal Mail thing to save face, and possibly protect his sellers rating.

I sell regularly on Ebay and have been known to cancel an auction or reduce a price because the cats have managed to destroy the item in the 3 days it took for the listing to end. I'm pretty upfront about it though.
 
I think many are being a bit harsh on the OP. Clearly something is awry with all this.

If you send something 2nd class signed for, they will not tell you if it has been lost, especially not on the day it was supposed to be delivered!

Also, something I sold got lost in the post recently and I am 99% sure I could refund the buyer at any point. In fact I specifically told him not to cancel the transaction or request a refund as the only reason I sold something was for a 2000 nectar point offer they were running. I just went to the paypal transaction from my ebay account and there you can input any amount as a refund (partial or full).

The seller has been dishonest and it does sound slightly dodgy to me, and for whatever reason has not sent the phone.

OP will get his money back though so he needn't worry about that.

just been looking through the listings and £255 seems pretty cheap,
first thought was that he didnt want to sell it that low, but he's not relisted it

You already seem to have it stubbornly stuck in your head that it's a scam, so I doubt it is worth trying to convince you of any other possibilities.

If the guy was legit, or had any intention of refunding me, he would have done it already. Don't worry, I won't be using MM. I would happily bet someone £50 though that this guy won't refund me before the 28th. Why would I do that? Because I know this guy is a scammer, you get a feeling of people

Ask yourself, why would you send a £250 phone untracked, via economy delivery, open yourself up to items missing and then on the day it was due to be delivered, why is he saying royal mail told him the item is missing?

On what planet would royal mail contact someone before the delivery date and say " your parcel was due to be delivered today, unfortunately we've lost it, sorry " once you get past that, the only other option is he has not sent the phone
 
MM is amazing, why wouldn't you want to use it?

TBH even if he was a scammer, you knew the possibility and you are covered. Your refund is on the way whether the guy pays you or not, so it isnt really a big deal.

If you don't believe him about the postage, contact him and ask for screenshot proof of the RM lost delivery message for [insert plausible BS reason]. If he refuses or, then he was likely a scammer and even if he doesn't believe you and is telling the truth, he will send it to you.

Seriously? Clearly something dodgy is going on. I don't quite get all the negativity towards the OP.

It may not be a scam in the traditional sense, but something dishonest is going on.

Maybe you should be banned from the members market if you think the way the ebay seller has carried out the transaction is ok? :eek:
