Injury Claim canceled?

I was involved in an accident on my motorbike at the end of 2014 (not my fault, the other drive admitted liability). I put in an injury claim as I broke my arm and fractured my leg making me unable to do my job for a few months (I need both hands). The police told me to put in a injury claim for damages, which I did shortly after.

A few months ago I started getting letters about going for a physical in London (5hour drive away). I refused saying its too far away and there is no point is having a physical done as nothing is wrong right now (everything healed). Told them they have access to my medical records to prove what happened and left it at that. This saturday I got a letter saying the following"

"In regards to closing your claim, I must advise you that there are costs involved for undertaking the claim and working on the file for you, this was based on the understanding in the retainer you provided us as you mentioned the injuries sustained.

The relevant department will be in touch to discuss the costs incurred."

And some other drivel about if I want to pursue my claim contact them asap etc

Anyone have any clue what this is? I have not closed my claim. The last contact I had was last December over the phone and they said someone would be in contact if they need anything else.

I'm going to call them tomorrow and ask what the hell is going on, but do any of you have any idea what this is? have they closed my claim without telling me or something? this is a no win no fee claim (I have all documentation, paper and email to prove I don't have to pay anything) so I don't have any idea what they are trying to pull.

Any advice is welcome!

Who did you put your claim in through?

Your ins-co or some independent scumbag lawyer firm?

silverbeck rymer.
Had a chat with the police about, and they said go with them.
Also had family and friends who have used them before without issues.

What does "all documentation, paper and email" say about what happens if you don't attend your physical?

I got about 3 physical appointments, all of them in London.
I phoned and refused because too far away, I can't get there and no point having a physical done at this point.
They didn't say anything about it on the phone about it once I explained.

The only thing in the documentation is
"Attend all meetings, Court hearings, medical examinations or other appointments that Your Solicitor asks"

I told them I will not be attending a physical in London, and nothing else was said BY them about it. If they where going to force a physical or book one near they would have said something.

Be unlikely for anyone to write a medical report in your favour without actually seeing you and examining you, despite there being nothing currently wrong.
Easy for an expert witness to do it from your notes, but that is generally to punch holes in a case rather than build one.

You were told to attend all medical examinations but you didn't.

Does the contract state they'll recoup costs if you fail to follow up on their requests?

Sounds all pretty cut and dry if it does.

People seriously claim compensation for an accident. What is the world coming to.

To be fair its hardly whippy compo is it, he was unable to work and suffered loss of earnings.

Would you be totally ok with somebody driving into you and as a result you losing a few paychecks?

you need an independent examination, you refused to go for one on 3 occasions, therefore they cancel your claim.

If that is where their consultants are, you have to travel unfortunately. It would only be a day out of your time, for 2 months wage, I would happily spend a day traveling.

It would also have been something you could have claimed for as well as part of the compensation.

Then they should speak to their employer. It's an accident. The other person didn't mean to do it.

What has the employer got to do with the accident? Most stupid thing to suggest that is. The at fault party's insurance company should cover the cost, that is after all why we all have insurance in the first place! Notice the part at fault, that is because the accident wouldn't have happened if the party at fault hadn't caused the accident.
