CEX phone trade in question

Hi All,

quick one

Girlfriend just had a voicemail from CEX.

she sold her mobile phone to them in August, They are now saying there is an issue with the phone and they need to discuss the sale.

She hasn't called them yet, But seeing as
a) the phone was perfectly fine (I can vouch for this)
b)it was ages ago and they spent and hour supposedly testing it

If they want any money or the money back do they have a leg to stand on?
 
I suppose if it was stolen and blocked then yeah I think they may have some comeback but other than that, surely it's sold as seen.

Even then how can they prove it was his gf that had it blocked and not whoever bought it, I'd tell them to jog on never mind what the issue is.
 
They tested it so it must have been to their satisfaction at the time. If they've found a fault with it now then they weren't thorough enough before. Just tell them it's their problem and not to contact you again.
 
Just call them, ask what the issue is and laugh at them! Its 6 months ago and they tested it prior to handing over cash so I cant see them having any leg to stand on unless, like someone else said, it was a stolen phone. At the end of the day you have given them no warranty when selling it to them.

They probably have mixed up records.

I'm guessing that's what the phone call will be about. They'll start probing about whether it was a contract phone and whether she fell behind on payments at all etc.

Aye unless it was stolen or reported lost I cannot see how they could have any comeback 6 months after buying it off her.

Iphone 6 that had a replacement screen or similar at some point? ;)

We still don't know if that is what has happened. I don't see them ringing back 6 months later because of a defect as they have no comeback.
 
Either way you've got to call them back just to find out what it is you can't leave us all hanging.
 
Tell em to get lost... they tested it and bought it off you. They take the risk that an item may go faulty after they sell it.

The phone must have been icloud unlocked and reset for them to buy it so its not that... and if a phone is IMEI blocked due to insurance lost/stolen report then its also a risk they take. If it is reported stolen it become the property of the insurance company and CEX have no come back at all.... thats the risk they take buying any phone.

If it was her phone and she hasnt reported it stolen then its not your problem either... but if you sell a phone and then knowingly report it to try and get an advantage then you can be in trouble for fraud, but its the insurance company who would come after you.

I'm pretty sure that's not a risk they take as they are the victims of fraud.

The person who commits that fraud is culpable and the cex has a claim for compensation.
 
Isn't that why they require ID when you sell a phone to them? That way they can say who sold it to them if it's reported stolen.
 
Used to work at a CEX, if anything was deemed faulty it would come out of the wages of the staff member that traded it in, they would never go back to the customer even if it was that day, let alone 6 months down the line!

This sounds like your phone has somehow developed a fault (not your problem) and now the staff member is trying to cover their own back before having it docked from their paycheck.
