Question about NHS & DBS check?

Hi guys,

Got a bit of a predicament, my partner has recently secured a position as a healthcare assistant working at the hospital for the NHS. Tomorrow she is going to give details for her DBS check. As she has already filled out her application form, had an interview, references received and been given a start date, she is just waiting for this DBS application to be sent off.

She received an email this evening regarding the DBS check and details of things she needs to bring with her. When looking closer at the FAQ she noticed a bit about which convictions that will show up.

My partner (now 33), when aged 14 got in a scuffle with another girl. The other girl came worst off and my partner was charged with ABH. She pleaded guilty, accepted this and moved on with her life. She was told by the police officer at the time that after 5 years it would be wiped from her record. It has never been an issue for her and has never caused an issue for her and her career. However after looking at the DBS filtering guide, she noticed that ABH will always show up and will never be filtered, regardless of the age at conviction or the time passed. She is absolutely devastated because she believes this will stop her from getting her dream job and will stop her from progressing and studying to become a midwife. The other thing is, because she didn’t realise it would show up after what the police offer had told her, it now will looks like she has tried to be underhand and lie on her application.

Can anyone shed any light on the situation and the best way to move forward?

I'm trying to remain positive for her sake, however its difficult as I don't believe she has a chance in hell. I feel so sorry for her, she made a huge mistake in her childhood and has since matured, bought a house and had two beautiful children and had a job since aged 16 and always worked hard in her life.

Any advice or help would be greatly appreciated, thanks,

I would potentially be open and honest and advise that she was informed at the time that the charge would be removed from her record after 5 years and that since she applied for the job she now believes that it is still there. Though I would have thought that after this long it shouldn't be a problem. Reason I say that is that I have fraud on my record and although the conviction is now considered spent I was told it could still affect my chance in my current job due to it being FCA regulated. Came back all clear for me. Though I'm sure any convictions before the age of 18 are ignored anyway
 
As I understand it, she should have a clean record. There is or was, a clearing of records for misdemeanor offenses after a given time for juveniles. I know because I got a warning for vandalism when I was 14 and was told that after 4/5 years it would be removed from my record and this turned out to be the case. As now I have DBS checks every 3 years for the voluntary work I do and my record is always clean.

Any idea when this was? How old are you now?
 
It doesn't mean she won't get it as long as she's been honest about it.

I did some work at a site that required DV I was honest about an incident in my youth and I still got the job.

Between the interview and how honest you are about it I imagine it's more to catch the people trying to hide something.
