Need some advice.

I bought a clutch kit from a Ford main dealer A just over 2 years ago, genuine fords parts obviously. They've been stored unopened for a couple of years as my existing clutch lasted longer than I thought.

I have just got another main dealer B to fit them, where I originally bought the car. Having done this, on pumping the clutch pedal, a seal in the release bearing has popped out, leaking hydraulic fluid everywhere. They state that it was a faulty part, and it wasn't through any wrongdoing on their part.

It was already a £2K bill and this will add over £650 for the parts and labour to rectify.

Main dealer B wants me to contact A to see what they can do. I'm expecting they won't accept any responsibility as it'll likely be a 12 month warranty.

What would you do? I can't accept that it's reasonable a part could fail, sitting in it's unopened box, after just over 2 years despite what the warranty says. Is there any legislation or law that would suggest a part should last a reasonable amount of time despite it's warranty?

I could make a complaint. If that goes nowhere would anyone suggest I take it further? I'm not even sure I know what that would be.

Or do I suck it up and accept it's out of warranty?
 
Try dealer A first then contact Ford customer relations department direct asking for some help.
When I had an out of warranty issue with Audi the dealer rang Audi and got a good deal for me.

Maybe sale of goods act / consumer rights act. Would basically say it needs to be fit for purpose and working etc and last a reasonable time.

If it has been sitting in a box (can you prove this? perhaps the other dealer opened it / broke seals etc and can verify it was was unopened?) then it was not fit for purpose. But you'll still probably have an argument on your hands and will depend how much you push it.

Even if it was opened and used you still might have an argument depending on whether it lasted a reasonable time etc and how long the part should last.
 
Err to you mean the slave cylinder, is it a hydraulic clutch,?

Could just try new seals, why so much money?

Yep I'll do that tomorrow morning. Going to be a long drawn out battle though I think.

The dealer B can vouch that the part was untouched, he mentioned that on the phone. They had escalated it within Ford on my behalf too but didn't get anywhere.

dealer is no way liable.
are you sure its not the main rear seal that has gone caput.

Most of the cost is to get back to the part and refit, as the car had been put back together when they tested it.

It's this fella, and they say the seals had blown:

They have put it aside for me in case I need it to help my case.
 
You went to ford to fit the RS clutch? Are you mental?! I paid £850 supply and fit! The slave cylinder is only around £90 so not sure where you're getting another £650 from?
 
You still some warranty on the work, even if the car as a whole is out of warranty. If it was a faulty part why did they still fit it and send it out the door? Did they not test it?

You would be correct if it was a part supplied by them. But it was supplied by the OP.
