AuctionBay Faulty Item - Newbie advice

If the buyer thought it might not work then it should have been listed under 'for parts or not working'.
As he has described it as 'used' then if it doesn't work the buyer is perfectly entitled to a refund regardless of what the buyer states in his auction.
 
Seller stated it was untested and may or may not work in the listing, which I presume you read before clicking buy, and you must have thought it was worth a shot.

So whilst you could pursue it, and will probably win because they put it in the wrong category, IMO you should chalk it up to experience and leave the seller alone. It was your mistake.

The seller stating the item as untested does not remove them of all responsibility should it not work upon arrival.

It's the seller taking the risk by selling as untested, not the OP, as a buyer should expect to receive working goods unless the seller specifies the item as spares or repairs.

You can return it then.

"I'm not sure if it works or not" is not good enough, either it works or it doesn't. You don't then sell it off as used / working.

You state clearly, yeah it doesn't work, here I listed it as for parts not working. Not, i'm not sure... so i'll list it as just used.

Tell him to refund you and send it back, the no refunds means nothing. Who knows whether the seller is also telling the truth, did he test it? did he know it was broken?
 
How much did you purchase it for? If it is a little then just learn and move on if not maybe worth opening a case because it was listed as used rather than for parts or not working.

It's **** like this that allows eBay, and the fraudsters that infest it, to keep on getting away with their shenanigans.
