Local Schoolboy Vandalizes Several Parked Cars

You need to take this to the school as if he's carrying a knife about they need to know about it, how would you feel as you have the footage of him carrying a knife in his school uniform but didn't alert the school and he stabs another student?

unfortunately you just don't know today. 11 year old's with knife, 15 year olds with guns. The battle is never ending but i have told the teacher i spoke to that teacher and mentioned police and i have identified him carrying a knife. Do they follow up ? I am getting inpatient at work and i am concerned what if he comes down the road again. I would love to be casually passing by and see him. I don't think i will be able to control my fists though :D

The headteacher has a statutory power to search students for prohibited articles such as knives. I would certainly be hoping they do this as I would say it is likely that this dumbass regularly brings a knife to school. Although they don't need the police present, they should probably do it as they can turn the knife over as evidence straight away.

I certainly hope this chump gets what's coming to him - but I know he won't. He is like 12 years old and he'll turn the water works on or say how he is depressed or something, and people will sympathise with him and forgetting about the thousands/tens of thousands of pounds of damage he has deliberately done.

Whatever you do don't confront him directly (unless you actually catch him at it again). That might hurt your case!

Society today or is it an EU Law that you do not have the right to defend your property from theft or vandalism with controllable force. There is a lot to say for the Old EU Block and Communism. Unfortunately the Boy may already be past saving. Rehabilitation for him is just pointless. I can only see HMPS awaiting in the future

as a kid I've done some crazy things but damaging someones property on purpose was never a thing! :o

kids these days, never mind doing that... why is he carrying a knife? wonder what his parents must be like.

Yes that is a very good question. I would love to meet them and say what a wonderfull boy you have brought into this world. :D

Be interesting to see what happens with this but if one of my kids did something like this, they'd be grounded till their 60th Birthday!

If they resolve it (pay for it etc..) then you can drop the charges if you want to. That might be enough to scare the runt into not doing it again.

Sorry, a little OT, but my pet hate is when people say "drop the charges". That's an American thing. In the UK, you don't get to make that decision. You can withdraw your support, but a prosecution can be continued anyway.

Seeing as I'm in the middle of revising for my criminal law exam and have my textbook out :p

Clearly you aren't going to get away with just pummelling the lad but..
s3(1) Criminal Law Act 1967:- " A person may use such force as is reasonable in the circumstances in the prevention of crime..."

However, the use of some force must be necessary. I suppose you could argue that if you went to restrain him from scratching your car some force in restraining him would be appropriate because he had a knife? More likely than if it was just a key anyway. How good is your lawyer? :p

The actual force used must be proportionate. Objective test - would a reasonable person consider that an appropriate degree of force used in view of the danger which existed. This test is great if OcUK is on the jury :D Not so much if not..

So long as he's over the age of 10 he's over the age of criminal responsibility.

Of course it could turn out that he comes from a very well to do family and this is totally out of character.
TBH that might be the best scenario for the OP as they might pay up pretty smartish.

I have spoken to teacher at local school over the phone, awaiting the head to call me back. The Teacher was very shocked and interested to identify the boy

Interested to hear the outcome.

Thanks for the edification. However, I have in the past been asked if I wanted to pursue prosecution (in this country) and I said no. So they let it go. :) So just basing it on my experience. Perhaps I got the wording wrong. But a pet peeve... really? :p

Update!

I dind't see he used a knife until half way through the thread, he actually has a knife? This just turned from fairly bad to majorly serious.

Why? What a stupid thing to do, I hope he gets caught ASAP before he damages even more innocent peoples property. It appears those cameras were an excellent investment.
