I'm not sure he can be cleared of a sex crime but still have to do this.

Unless it's poor wording I would have thought cleared would mean they found the accusation false rather than not enough evidence :confused:.

you can be found not guilty but still be persecuted for an alleged offence

The prosecution at York Crown Court alleges that O’Neil, 44, of no fixed address, raped a woman on July 19 some weeks after he saw the doctor. He denies the charge. "

Maybe that had something to do with the judgement.
 
The order requires Mr O'Neil to disclose any planned sexual activity to the police or face up to five years in prison.

I can only assume that's really badly worded since it mentions any sexual activity and also planned.

Yeah exactly. I'd be phoning them every few hours to say I was planning to rub one out until they got annoyed enough to realise how stupid the entire thing was.
 
Can the police refuse him or do they need to take any kind of action, if not then what's the point ?
maybe they need the persons details and contact number so they can phone the person and warn them.
 
I think this is one of those cases where there wasn't enough evidence of the actual rape but the testimony of the GP led to this being implemented. Some may think its unfair but if you take the recent case of the toddler who died from what are believed to be sexual injuries caused by her father but due to poor investigation/evidence keeping he has been let off scott free, not for evidence against that he did it. Now if something like this appropriate to his situation was put in place despite not being convicted would you disagree with that?

So basically he was cleared of rape, but has potential mental health issues. Why the hell should be he be named?
 
Another guilty until proven innocent but still being treated as being guilty. Only in the UK that can happen.
