The nervous wait to exchange....

Hindsight is wonderful. We didnt know all the details straight away though and with everything in place it should have gone through quickly.
That's the confusing thing. We are awaiting a death certificate from the sellerfor his wife as the house in both their names. Now the seller's solicitor has mentioned she is awaiting probate which has totally confused our solicitor because as far as we know, the seller is still alive (he went on holiday, liked it so much that he stayed).

Should find out tomorrow. Have lined up viewings elsewhere anyway.

Our FTB timeline..

Offer (subject to survey) accepted 5th July, house taken off market
Valuation completed 12th July, mortgage offered same day.
Home Buyers Report completed 19th July, flagged up a couple of minor things but mentioned that some windows are miss-aligned/ill fitted (which we didn't notice on 2 viewings).

Have said, that I would want to re-negotiate with vendor, estate agent was dismissive as expected. Not sure if we are being petty, would have no idea on what it would cost to put right nor how much bargaining room we have.

House is tenanted currently, tenants are moving out early September; I wouldn't expect seller would want empty house with reduced income nor wanting to delay the process. Advice appreciated!
 
Could have meant she's awaiting probate for the one who'd died? Not that it should be needed assuming they were joint tenants..

She died 3 years ago and was never removed from the deeds. Death certificate requested and then she came out with that (after 3 days of not being available).
I have no idea whats going on at the moment as she won't commit to a date. I honestly can't see what the hold up is apart from 2 weeks of not packing anything despite being told they had. Clearly they forgot that I had been round there twice in that time.
 
Another hit in the process,

So after finally getting all the documents regarding the Garage Conversion, They had a letter from the council admitting planning permission is exempt but they attached a building regulations exception sheet that only accounted stuff like conservatory.

Our solicitor contacted the council building regulations office and they even said yes they will need it approved and signed off.

So now the Vendors will need to get the council to inspect and approve the work that was done, So this is another 1-2 week delay depending how fast the council can get it checked, And this is all hoping it gets a green light at the end or it.
 
Had an offer accepted, now waiting for final finances to go through and inspection.

Back in our own place after 4 years, hopefully. :D
 
Looks like after 16 weeks we might be pulling out. The seller is so disorganised that our solicitor thinks this will drag on for another 3 months (The probate thing has just started, not really sure what it all means but it won't be resolved in a week).

Viewed 2 houses today and both look promising (no chain on one, the other has had a buyer pull out due to personal circumstances and the seller is due to complete next month). We'll have to rent again as the landlady wants the house back to do work on it (half assed job again no doubt).
 
Still, last thing I'd be doing! I wouldn't want to be the one blamed for putting the council on notice for unauthorised/non-compliant works :p

Well it wasn't instructed by me todo :)

Anyway turns out the Vendor has had a right go at their Solicitors for being idiots, And Phoned the Council their selves the day prior, So hopefully long as everything is in good building order, We should have a certificate Tuesday!

Surprisingly it seems the Council have stated they needed it, But their Solicitors was going to argue the fact we didn't need the certificate.... Amazing really.

Odd. I'd get to the bottom of why they require probate (i.e who for). Unfortunately if probate is needed its a massive delaying factor at the moment that's causing a lot of problems. Average turnaround for a grant of probate is 6-8 weeks from what I hear.


Had a matter last week where the sellers were selling as deputies of X. Was due to exchange on the Friday, buyers solicitors didn't respond to me to exchange, X died over the weekend so now the deputies can't legally sell and we need to wait for probate, extremely complicated estate, could take ages before the sale can go through :eek:
 
Sent my solicitor a 'nice' email yesterday as he is a right muppet.

Having issues with Land Reg and he is telling us he has things sorted and all will be sorted by 'last' friday and total lies! Land Reg said nothing of the sort! They stated our case has not even been allocated a case worker. They say it could take weeks yet!

Looks like the daughter is due to inherit a percentage of the property but they need to work all that out. Her mother passed away 3 years ago without a will. I guess this means her father won't get as much as he hoped as it will be split.
I've put in a new offer due to all the delays and lying, told the estate agent that the seller was clueless and it should have been sorted years ago, their recommended solicitor had no clue and they themselves were part of the problem as they can't write a phone number down properly even when its emailed.

Yeah, end of my tether on this place. I've given them until tomorrow to accept the new offer. Lost interest anyway which is why it was so low (15k under previous). Would have been happy to pay the asking price if we had completed by now.

Still, onwards and upwards!
 
These type of 'blame lies on the other side' problem are why I'm reluctant to do work for friends/family (other than my dad's purchase which I think was completed in 4 weeks :) )

My boss has had an absolute nightmare dealing with his neighbour's sale and purchase, easy way to have a fall out tbh.

Well, our so called solicitor is massively to blame as he has not been doing what he said he has been doing! We will not be using him for the purchase when or if we find somewhere.

We've been told the house would be packed up next week ever since the end of May. Its still ram packed with stuff so anyone I have round to get quotes from can't give me what I need at the moment. Spent the morning emailing each one and telling not to worry about the quote or to cancel them coming round.
Constantly told the packers will be back the next day, but if it was a company doing it, they would have done the whole lot by now.
Estate agent tells me he's left voicemails too. No voicemails left in the past month. Or missed calls. Or call backs when requested.
 
Through experience i know that some solicitors need constant reminding and kicking up the butt! Mine knows that i am now his shadow!
 
I was hoping to post in here with positive news today as we'd applied for a mortgage with hsbc to move from where we are to somewhere a little bigger but we've been rejected based on affordability. Despite having just over £1700 disposable between us based on the new mortgage payments (borrowing 244k, 60% ltv)

I guess we were hoping for a little too much based on customer loyalty having both banked with them for over 20yrs. Still, computer said no!

So we've gone to a broker and have a meeting on Monday afternoon, fingers crossed it's positive. Having provided the numbers we gave hsbc, he couldn't really see anything wrong. So we'll put it down to hsbc being fussy.
 
Got my new mortgage offer from nationwide within a week, fast turnaround from them! (as broker already had all my info from previous mortgage)
