Hi,

A family member has passed away (car owner and policy holder), how do you go about transferring a car to another family member?

I assume I'll need to sort tax, owner form and insurance..

Afaik, it's roughly half way through insurance policy. The person who will now own it is a named driver on the current policy.
 
The vehicle forms part of the deceased's estate and is treated as any other belonging. You can't just take it.
 
The last time I did this was over 5 years ago, but we went to the local DVLA office and sorted it there and then, more difficult for us though as the car in question was tax exempt for disability reasons.

This isn't the right place to ask, but I'll ask anyway..

If there is no will and all children of the deceased agree on it, can one person just take ownership?
 
Things get a little complex with an intestate death (death with no will), so it's probably best to read up on it and/or get advice.

In theory the spouse of the deceased should inherit. If there is no legal spouse/civil partner, then it passes to the next generation - the children. Bear in mind that the vehicle is very likely to be part of the estate for the purposes of calculating inheritance tax if the estate is over the limit for inheritance tax.

Somebody will need to be the administrator of the estate. This can be a child/spouse of the deceased, but not a partner.
 
That's good info and it looks to be a fairly simple and straightforward process.

I find it interesting that the vehicle doesn't count as part of the deceased's estate. From my family's experience when relatives have died, everything they owned became part of the estate. Bear in mind in my case, the vehicles were sold before the owner died so we didn't have to go through this.
 
When my father passed away with no will we followed the instructions in the links provided by Amleto and it was very easy. They handle the process very delicately and with compassion and the new v5 came back swiftly with my brother's name on it as we requested.
