Became aware of an incident whereby an visitor was found lying on top of a resident in a care home with trousers down and his hand on her bust. The lady in question possesses no (mental capacity) and the alleged abuser is 80 years of age with memory issues. Police have informed the care home they are reluctant to prosecute due to the age of the perpetrator and memory issues. The alleged abuser was kicked out of the home only to turn back up the following day where he was refused admission.

Of the course the police wont pursue cases like that, how could guilt ever be proved when they both have mental issues

and at 80 years of age its possible that his mind is now going senile , what would we do with a senile pensioner even if they were found guilty of a crime? What purpose would any penalty serve?

It probably happens more than you think, even sex offendors end up needing care. We once had a social worker make a refferal to our care home. The social worker neglected to say that the man was a registered sex offender and had run brothels in the past. Due to our due dilligence or pure luck managed to find out.

Was the running of brothels linked with being on the register or was it a different offence?

If he was just running a house where escorts do their work and he takes a cut, it may be illegal but i dont see why that would be such a big deal if he was a retired resident of a care home years later.

Brothels are illegal here because of the view the general public have toward them and the corruption and abuse committed by organised criminals, rather than because it infringes on societies 'sex morals'. I mean, its not like he was gonna set up business at the care home xD

Some first world countries have many areas where it is legal to have brothels and it resulted in cleaning up crime linked with drugs, human trafficking and also made the act of going, much safer.
 
Oh you've done it now, telling GD that they can get away with sexual assault if there is no proof of mental capacity.
 
I think persuing these cases are fruitless and take up far too much time and money.

OT a lil and dont try to draw my opinion from it but where does GD draw the line with mental incapacity/being old?

Prosecute for:

Petty theft < significant Tax fraud < Sexual assault < Murder < Nazi war crimes < posting a thread about the MM

It is odd that the incapacity makes a difference for the severity of the crime. Does the severity make punishment more fruitful? Maybe, as it may help in preventing another crime.

The abuser has only short term memory issues and the abused does not recognise the abuser. Apparently there were previous issues regarding the abuser and abused which led to an acrimonious divorce. If you were to mention his name, the abused would recoil in fear. He has been visiting her on a regular basis and treating her leading her to think he is a different person. Her being non the wiser due to her Alzheimers.

Well why wasn't the staff making sure they were separated at all times?

If he's a dirty old weirdo who had terrified the lady before, he shouldn't have been allowed to get close to her. The staff failed big time.
 
Surely this is about the deficit in the care given to both people from the home. If what you say is true and this all known then the safeguards are inadequate - if any police investigation was to ensue that is where it should be focused for gross dereliction of duty resulting in someone being placed in direct harm.
