Parking here - is it legal?

Hi

I park my car on my drive way and I live on a busy road, I find it very difficult to get off my driveway at the best of times due to high traffic. However for the past 2 weeks my neighbour has parked this van here obstructing my view to getting onto the road.

There is a single yellow line on the road, and a sign saying parking prohibited between 3am-6pm Monday to Friday. Yet this van is here between these times.

Anything I can do about it? He has 2 cars already parked on his driveway and this is his van for work I presume.

Rule 244 of the Highway code...

You MUST NOT park partially or wholly on the pavement in London, and should not do so elsewhere unless signs permit it. Parking on the pavement can obstruct and seriously inconvenience pedestrians, people in wheelchairs or with visual impairments and people with prams or pushchairs.
 
The yellow lines apply to the pavement as well as the road so yes he's breaking the law report him if it's causing you issues.
 
Best you can do is have a nice word with the chap long as you get on
As when you report it to the council they will say ring 111 and report it to them .With nothing getting done by either just passing the buck.
 
Where I live we have the same problem with our neighbours, 2 cars 1 van and no driveway.
He started parking his van on the grass and it was ok in the summer month's but in winter it was churned up and a total mess.

The council ended up putting wooden bollards in the grass to stop him parking on it. He removed 1 or accidentally on purpose reversed his van into it so he could drive on but got billed for refitting it off the council.

He now bobs it on the corner on the pavement so you can't see anything at the junction, or walk past easily and the council or police don't seem bothered.
 
I'd rather that than my situation. Guy parks his van completely on the road but less than a meter from the edge of the driveway so you've got to be halfway into the road before being able to see past it. Wouldn't be so bad except people on the other side park on the road too so all traffic has to come through the middle of the road, basically if I time it wrong and someone is going a bit quick its a guaranteed accident :o
 
Well I have called the council, they have given me an email address to report it. So that has now been done.

If after a week, he is still parking there, I may take a photo every day and email them, until it is sorted.

I spoke to him about it, and his answer was "but there is no where else to park it"
 
Does a grass verge count as a "pavement"?

Highway Regulations aside, and IF it wasn't obstructing views, it isn't blocking pavement access.

Always wondered that; never dared do it myself.
 
It's difficult because he's not obstructing the highway or causing an issue for the traffic. He's not obstructing the pavement either as people can still easily get passed.

The only thing he's really doing is obstructing your view when you pull off of your driveway which millions of people who live down busy streets manage to work around everyday.

At the same time, that land isn't a car park and he shouldn't be parking his van on it. You've done more than 99% of people and spoken to him about it so that's good. It's his problem to figure out where to park his van, not yours.

It's not difficult parking restrictions on the highway apply to the verges and paths as well. You can't get around a single or double yellow line by saying it's ok I'm not on the actual road.

And who are you going to get to enforce this? In the real world, no one is likely to do anything about a vehicle parked that isn't obstructing traffic and isn't obstructing the pathway.

Which leaves the OP in a difficult situation.
 
Annoyingly, now op has spoken to the culprit, he's going to know exactly who reported him if the council do decide to act on it, which is going to make things awkward to say the least!
 
In a lot of residential areas there are actually bylaws saying you can't park commercial vehicles there over night, even on driveways. Where I live it restricts caravans as well.
