Can't Pay? We'll Take It Away!

Here we go again.

They've caught a gut in his friend's house.

They will take everything unless everything in the house is proven to be not his.

Their defence when confronted is that they don't know for sure it is his friend's.

Apparently "that's how the law works". When confronted if they can take his friend's stuff, they say no, but unless receipts show otherwise they say they will take everything.

In this case they backed down from their threats pretty quickly (or at least as presented). But likely cause these weren't clueless people who would just be a walkover.

I don't get how this isn't trespass though.

How does showing receipts prove that I own the stuff in my house? All it proves is how much the stuff was and where it was bought from.
 
Just watched tonight's episode. Enjoyed it. Favourite ever episode was the one with the scouse garage owner, [muchhandwaving]"Ya carn 'ave it I carn pay it"[/muchhandwaving].

It makes me laugh when they fold.

My wife is watching that episode right now and she said they had a Court Order

I know they did. You check what it was for?

Did it say it gave an all access pass to private property?

Police warrants are more specific than that.

People asking how it's not trespass or burglary, you guys serious?

The home owner let him in and the writ allows him to remain in the property and seize all goods they believe belong to the defendant at the address on the CCJ. This is the same for all such writs, standard practice.

It's as though you are surprised that laws can be enforced, do you think that courts, police, prisons etc are just for show? :confused:

Here we go, threatening a woman they "will" remove goods even £7k isn't paid for someone else's debt who happens to be staying there or unless the person can produce receipts. Bank statements wouldn't be good enough and the fact it's her property means nothing.

The woman is distraught.

What's the point of the apology afterwards.

They're intentionally picking something they know, nobody would have anyway.

Once their bluff was called and "they didn't have time" to go through receipts for everything one by one. They wanted something which showed ownership of everything at once.

They are just bullying debt collectors with everything except for the physical violence, although they will make their presence felt. Come across anyone small yet on the programme?.
 
Being big is pretty much a requirement of the job, as otherwise you'll run into someone who'll batter you sooner or later. That doesn't implicitly make them bullies.
 
Most bailiffs or what ever their legal name are bullies and thugs. Goes for most doormen/bouncers too.

You have to have the thuggish mindset to carry out those jobs.
 
Do people not keep receipts for their more expensive items?

At the end of the day the HCEO's are hardly going to turn up and threaten to take away a bookshelf, or a set of cupboards. They'll look at high priced goods, typically electronics - TV's, Stereo systems, games consoles, PC's/Laptops etc. Surely you'd keep your receipt for those even if only for warranty purposes?

Also with all the stuff that people buy online these days, you'll have a digital receipt emailed to you. Or purchases through Amazon for example are all tracked in your account - and go back years.
