Does a manufacturer replacement remove onus on retailer?

Had a Xbox one s replaced but still suffers the same fan noise issue.

The retailer didn't have any to replace with i dealt with MS.

I can't send the replacement back until they close the first case. Hoping I may be able to sort it quicker.
 
How old is it, which retailer and do you have your receipt?

Your contact is with the retailer, depending on when you bought it you will be entitled to a refund as ms haven't sorted or have made it worse.
 
I don't know about that. Since the retailer didn't organise or authorise the replacement, they could say this isn't the device they sold.

I doubt they record serial numbers though.

Yeah I've got the receipt etc. I've had it since sept.

Prob quicker to get MS to sort it but I figured if I gave GAME a chance to sort it and the replacement was equally as bad. At least a refund woukd be straight forward
