How to proceed with a dodgy tablet repair company?

Hi,

Over 6 weeks ago my girlfriend sent her tablet to a company via for repair after it was dropped and the screen stopped turning on, they gave her a quote a few days later which she was happy with and authorised the repair with a deposit (Paid by PayPal).

Since then she's been chasing the company endlessly for the return of the tablet and they keep fobbing her off with excuses about unforeseen complications with the repair and parts being ordered for it, their communication has been poor to say the least with surly email and telephone calls when she's tried pressing them for information as to the status of her device.

On Tuesday this week after a few heated phone calls they declare that the device is fixed and request the rest of the funds before posting it back to her which she promptly paid via PayPal as she wanted some protection, the company weren't happy about this but were happy to take the deposit by PayPal :confused:, they eventually accepted it and told her the tablet would be posted the following day.

Today there has been nothing received back and when she asked for proof of postage they've told her that they don't have any, naturally we aren't expecting to receive anything on Monday either even though the company has asked us to wait until the end of Monday as apparently it was posted Thursday 2nd class...

If we don't receive anything by Monday, can we pursue this matter with legal action? If so, how? The tablet is a Samsung Galaxy Tab which is only about 6 months old and so is worth a lot of money to have it lost forever.

Its probably under warrenty with a proper samsung repair place.

Dont let her search for repair companies in the future. You might as well have let any "innit" phone case/libra/western union shop do it.
 
Surely in that case she'd only be covered for the funds she sent them, not the tablet aswell? Or is it possible to claim for the cost of the potentially lost tablet?

On second thoughts they would probably just refund the payment, might be worth giving paypal a phone to see what they say.

I doubt it about the Samsung warranty since it's accidental damage and isn't a manufacturer fault. The tablet was in her handbag and her dog pulled the bag off the table and onto the floor, that's how it originally happened.

Unfortunately I doubt she'll learn from this experience.
 
Soon as the date goes past the last day second class could be delivered just smack it straight into small claims.
