he doesn't need to do anything, if you are basically admitting fault and you decide to process it as a claim on your insurance he doesn't need to talk to his at all it can just all go on yours

if you want to "do right" by the lad then you could say that you hit his parked car - that would still be "your fault" but it would remove him as a person completely so when asked if he's had any "claims or accidents" he could quite legitimately say "no".

I had a car hit by a TNT lorry about 10 years ago and instead of going through their own insurance company they employed a 3rd party claims company because their excess is something like several thousand and making a claim puts their premiums up something crazy so its cheaper for them to handle most things off the books

For all you know the kid has explained what happened to his parents who have quite rightly pointed out you are 100% in the wrong.

He may have already contacted your insurance company at his parents request so if you are hoping to pay for his repairs outside of your insurers, then I suggest you call him asap with a decent offer before he calls your insurer.

You could also be reported for dangerous driving.

Its completely reasonable for the kids car to be restored exactly to the condition it was in before the crash, are you prepared to pay over what you consider a fair price? He holds the cards here, not you unfortunately mate.

Thread title is pretty accurate, if the lads going to go by insurance then i doubt youve got a leg to stand on. If he doesnt then might be good, sounds like he came off lighter and you can just treat the bill as a reminder to be more patient.
 
The only way this story could have been worse is if he was doing his hair in the mirror inbetween taking sips of stella from a can whilst driving too.

OP - treat others as you yourself would want to be treated. Put yourself in the kids shoes.
 
Before anyone thinks about "changing" material facts they should be aware that many cars have dash cams and it could be the worst mistake they ever make.

From 2 claims companies and my own insurance company having had 2 cars I owned hit whilst parked.

I told my insurance company at the time of the first one and they asked if I wanted to make a claim, I said no and they just said ok thanks fir notifying us. When my renewal came through THEY had already put it through as no claims or accidents despite the fact I had called them at the time.

Neither were claims I put in and neither were accidents I was involved in, I did a whole bunch of quotes over the phone with brokers and they also didnt make a note on the quote when I explained and no insurance company has ever come back to me after the fact and said they need to put my premiums up.

Of course the OP will be screwed if the lad works out it wasnt his fault and puts in an injury claim.

Best thing to do is fix his car up, apologise. Claim on insurance either way and insurance goes up for the kid now I think even if it wasn't his fault which is complete crap if true.

Aspire to be better than a BMW driver. ;) :p
 
My other half is a claims handler for a major car insurer, and they will know if you are talking ******** 99% of the time and react accordingly. Man up and you are more likely to get a favourable outcome (and it would mean you aren't a massive *******, which your responses thus far are doing a pretty good job of portraying.)

No, what you said was that saying he'd hit the third party's parked car would absolve the third party of the need to declare any claims or accidents on his insurance as he personally would not have been involved.

This is not true: whether the OP tells the truth or not, the third party can avoid putting a claim in on his own insurance, as in neither scenario is he at fault - he can just go straight to the OP's insurers. However, in the event of a claim, regardless of what insurance company you've chosen to make it through, most insurers do in fact need to be informed and may or may not take it into account and load your premium accordingly.
 
This is awful and why I literally don't understand people these days. so many people change when we involve cars.

Do the decent thing please and pay for it. i couldn't afford insurance at 17. At 19 when i could this would have made me not be able to drive again until low 20s. A grand or two for something that is 100% your fault is definitely the right thing to do if you have the money (which you should do if you have a newish bmw).

It should also teach you not to be impatient. Everybody makes mistakes. If we all thought about it we could find a time where we've overtaken a bit close or not stopped at a questionable yellow light. It has certainly taught me not to do it ever again once i realised how much of a douche (and dangerous for saving what, 20seconds?) move it is.
