YouTube and copyright music... Has something changed ?

From what I have noticed a lot of Music that is copy right gets the revenue from the Vid views so its shared ! I'm guessing this is only on some but it does it on my Vids I have done so thats cool with me as I'm not trying to make money just having fun & being creative.

Is there any rule against thread necromancy on this forum, because there needs to be one to avoid situations like this.

This video contains content from SME, who has blocked it in your country on copyright grounds.

Unable to watch your video from NZ, so looks to be perhaps outside of UK/Europe blocking?

Same for me but I'm in the UK (on my laptop).

Just upload to onedrive or something and send the link to family.

Edit: Bah dragging old threads up, bad Surfer! :D

Hi i thought i would post here rather than create a new thread.

So Disney have put a copyright claim on one of my videos.

this one

They havent taken it down or anything - they have just monetized it for themselves. That is, an advert will now play sometimes in front that they generate revenue from.

What the heck happened to fair usage? I am not attempting to monetize my video??? So how can they put a claim in against me?

I can dispute this but that may incur Disney's wrath and they decide they want me to take my video down. So i get a strike on my youtube account. 3 strikes and your account is banned right?

Is it my fault because i have not put a fair usage declaration in my video? And that if i do that now (in the video and or in the description) then i can get them to remove this copyright claim?

Coincidentally they didnt bother claiming against the other youtube video of exactly the same film footage as it much much fewer views hah

Your video is just a clip of their film, why wouldn't they claim it?

Doesn't look any different from people who record in cinemas albeit a short clip.

If you were reviewing the film / projector then you might have a case but probably not for that length of clip. Plus is fair use even a thing in the UK, thought it was just the US where you can use clips for parody etc.

I agree though copyright law is ridiculous and needs updating for an age where everyone likes to build upon others work, sometimes creating things that surpass the original but still can't be sold / monetised.

Ok in Belgium I get this message

Well i am using the content for illustrative purposes. According to some copyright sites this is fine.

http://cmsimpact.org/code/code-best-practices-fair-use-online-video/

TWO: Using copyrighted material for illustration or example

Sometimes video makers quote copyrighted material (for instance, music, video, photographs, animation, text) not in order to comment upon it, but because it aptly illustrates an argument or a point. For example, clips from Hollywood films might be used to demonstrate changing American attitudes toward race; a succession of photos of the same celebrity may represent the stages in the star’s career; a news clip of a politician speaking may reinforce an assertion.

PRINCIPLE: This sort of quotation generally should be considered fair use and is widely recognized as such in other creative communities. For instance, writers in print media do not hesitate to use illustrative quotations of both words and images. The possibility that the quotes might entertain and engage an audience as well as illustrate a video maker’s argument takes nothing away from the fair use claim. Works of popular culture typically have illustrative power precisely because they are popular. This kind of use is fair when it is important to the larger purpose of the work but also subordinate to it. It is fair when video makers are not presenting the quoted material for its original purpose but to harness it for a new one. This kind of use is, thus, creating new value.

And yes the UK has fair dealing (similar to fair use in US) :p

https://en.wikipedia.org/wiki/Fair_dealing_in_United_Kingdom_law

I am using it clearly for illustrative purposes, non-commercial use. Fair dealing and fair use is supposed to be flexible on the side of the infringer of the copyright.

This thread right now.

i started this thread 12 months back and faced the same issue on my videos i make of my family using any copyrighted music. i have come to the conclusion it is not worth it. just use free music or dont bother as it will get blocked in some places

Actually, anyone could make a content ID claim on anything even if they don't actually have legal claim of copyright (and I've been hit with one of them as one of my videos was hit with a content ID claim by a company who is supposed to be taking down illegal streamers, and doesn't even do that) since nothing is investigated which also affects the free music available from the youtube audio library (and if one if these supplying music for free typed wants to go commercial, you'll be on your way to the full course of copyright strikes).

As for your actual issue, you have to make a claim against the content ID claim stating fair use as stating it in the video or in the video description doesn't mean anything.

Well i have disputed it...i'll update the thread with how it goes. I have used the fair use argument though.

Well i dont have much to lose and i'm curious. Potentially Disney could strike my other video (with the same John carter content) and i also have 2 other videos which use film content (blade runner) so potentially i could get strikes against 4 videos. 3 = game over for my channel but i dont have much to lose as i hardly ever upload. Its not like i have a million subs haha

*update

Your dispute wasn't approved.

The claimant has reviewed their claim and confirmed it was valid.
You may be able to appeal this decision, but if the claimant disagrees with your appeal, you could end up with a strike on your account.

VIEWING RESTRICTIONS
None
MONETIZATION
Monetized by claimant

Appeal reinstated claim
Are you sure you want to appeal?
You must provide your contact information to the claimant.
One of two things can happen after you appeal:
Claim will be released: This lets you use the copyrighted material in your video.
Video will be taken down: The claimant can ask us to remove your video from YouTube, and you’ll end up with a copyright strike.Learn more
To appeal a reinstated claim, you'll be asked to verify your account, if you haven't already, and explain the basis for your appeal in detail.

^^ The problem is i am none the wiser. I am having to provide evidence but they provide none. There is no explanation why my dispute is rejected. Im betting if i appeal this i will also lose without any explanation at all. Seems very draconian system this....
