Actually I'd say it's very-much down to the police and subsequently the CPS/COPFS to decide, because they'll determine the charges. Juries don't decide whether or not something was a crime, they decide if the person(s) accused are guilty or not guilty of the charges.
You're right. And it was what I was inarticulately trying to say, I missed out the committed by x person though.
