If the caliper had seized to a reasonable degree then yes you would feel hot brakes / wheel & smell burning, however perhaps the brake is at the beginning of its failure cycle and is merely resulting in a pad not retracting a quickly as the other side.

Might be wrong, but i simply don't buy the other reason.

You'd also notice compromised braking.

It pulls to one side when braking, which could mean the brake efficiency on one side is greater than the other
 
We want it to booked by the sales guys / Manager due to the issues we've had with them since we've had the car.

You do realise that when you get through to the sales guy/manager, all they will do is walk over to the service desk and book it in stating that you've got a 12 month unlimited mileage warranty.

Just do it yourself.

No tyre information as I'm an idiot and forgot to note them down! (I'll try and remember today, promise!)

BMW are collecting the car on Tuesday and will investigate the bushes which they say are covered under warranty BUT they won't be if they prove that they've been damaged by a pot hole or 'curb crawling! (How can they prove this?!) They mentioned this before and we told them that we've not hit any pot holes!

Another new random thing that happened yesterday (though this might be due to the heavy rain we received yesterday) but when I was driving and the car was changing gear (automatic), the car felt like it was breaking and then a millisecond later, the car would be fine.

I'm not sure if something is sticking but this happened about 4 times last night when driving from Chichester to Havant.

Curb crawling is the act of visiting the red light district area and picking up prostitutes isn't it? :p

Get a free wheel alignment check first. Drive to any half decent tyre place.
 
Just take it to Kwik Fit for the free alignment check. All have Hunter machines now which IIRC are the newer ones with the fast clamps and OBD2 Vin decoder straight to the Winalign.
 
What you've bought is the extremely rare "considerate driver" pack. This is the car drawing your attention to the indicator stalk.

You'll struggle to prove it's not caused by damage inflicted by you unfortunately whereas had you returned the car as soon as you noticed the back in October they wouldn't have had any wriggle room, I hope your lucky if not it'll be a needless cost incurred, hope you've learned the lesson!

The latter sounds like traction control kicking in perhaps?

I had this with my Volvo and it was due to a sticking parking brake shoe but this itself may have been caused by a sticking brake calliper which you may be able to diagnose by feeling if the wheel is hot when the problem occurs.
