Hi all,

Hoping you can help.

Down the side of my house between my house and the fence separating us between and neighbour (detached) we are fitting a lean-to shed. I told my neighbour about this as he said he was looking to do the same but it may overhang into my side (that wasn't going to happen anyway, as I never agreed to it). We've started to get ours built and knowing that the fence belongs to the neighbour, we are making a structure that is not even touching the fence. It's actually held in by the raised floor (bolted to the side of my house) and the roof and the noggins that are in the ground (Imagine a raised decking type situation).

He shouted out this morning that my carpenter was leaning on his fence and then shortly after apparantly heard a bang and now his fence is broken.

He knocked on my door and took me round for me to investigate and it seems the upright support has come away on one and the other has actually broken (a piece around 12 inches in size). When I asked him where the broken piece was, he stuttered and said he's unsure. Surely if it had just happened, the broken piece would be on the floor, no? Also the snap in this piece looks the same colour as the outside of the wood, meaning it looks as though it was done some time ago and he wants me to pay for it.

He was quite confrontational about it all and started arguing with my carpenter.

I looked from my side and the main post that holds the fence panel in, is twister and the fence panel has actually come away a bit on my side but again looks as though it was done quite some time ago.

It seems it was done and he's trying to get me to pay for it by putting the blame for a historic issue on me.

I've attached pictures from my side, but am hoping to see what people's thoughts are as we have to live next to him.

You can see from the pictures that there is no way our felted panel can even touch the fence as the posts protrude out our way before the fence panel can even make a connection.

Thanks.

It looks like damage that is so minor its unreal.

Would take £10, wood and screws to fix that. Prob 20 mins of yours or his time.

Would take about £2 if that but he said "it looks like a new panel is needed.

If it was indeed our fault, I'd happily pay but I'm not one for paying for something when it's clearly not my fault.

I would side with your neighbour on this one tbh. The corrosion on the nails looks like it changes as if the panel has moved recently.
For the cost, I'd just sort it and be done with him.

Just say you will repair it yourself and do it.

Butting heads with the neighbour over something so petty isn't worth the time. I am willing to bet the fault lies with your carpenter leaning on it anyway. If he argues about the new panel, get him to explain and show you why. Take more pictures if he decides to try his luck

For the sake of a fence panel just have it done or offer to go halfs. Not worth the aggro.

I just find it really strange how it just happened but no broken bit was on the floor. Really strange.

I didn't notice any missing parts in the photos, I was referring to these nails having moved:

Looks like the whole panel has been pushed away from that upright support.

So the Carpenter has admitted to damaging the fence and offered to repair the damage?

If so, why is the neighbour trying to get you to pay for it?

THIS!

If you give in to this cretin now and pay up for peace and quiet then he will assume that you are a push over.....expect repeat behaviour.

Concerned about maintaining the relationship? Looks like he has ruined it anyway with his confrontational attitude.

Its probably no surprise with my emotive language but I hate people like this.

I managed to lean over to his side and take some pictures. This is his side but the broken bit is no where to be found.

I don't want to give in as he will probably take advantage in the future and that simply isn't happening.

He said he hasn't broken it but for the sake of the wood which he probably has some he will take the hit on it.

You don't need to give in, you didn't damage the fence the Carpenter did, why isn't he sorting it out?

EDIT: Okie, so the Carpenter didn't do the damage (Didn't read the above post before posting :D)
