No one did. It was clearly broken before but the carpenter has told me he will sort it to keep the peace if he'd let him.

You can buy those thin strips really cheap, it's a 5 minute job.

The break point on the upright his side is clearly where there was a knot in the wood & it has split - pre-existing defect yo

I'd just get some bits of wood & go round & replace that section tbh. It will cost a few quid tops & really isn't worth the bother arguing over.
I'm guessing your neighbour is retired/unemployed.

I'm sort of siding with the neighbour here as well, looks like the panel has been pushed, I don't agree with him 'kicking off' though, surely with you having a carpenter onsite he could fix this in 2 minutes to an acceptable standard.

It's definately not a replacement panel though so whatever you do don't agree to that.

Upon further inspection it seems that the fence post is twisted and I think that's out unnecessary stress on it and cause it to buckle therefore if anyone's fault, it's the house builder who put the fence up.

My chippy said he'd go and sort it if he lets him etc... so at least I don't have to deal with him or admit I'm taking responsibility.

Oh, and agree with your neighbour for the carpenter to fix it. Tell them post fix about how the carpenter sees this all the time in strong winds where a defect in an upright strip causes it to split and leverage away. Tell them about how your new shed will stop that. Tell them they're welcome.

Draw up a contract mandating the replacement of the fence panel. Replace the fence panel with a panel 6 ft taller than existing fence. If challenged point out that the existing contract didn't specify size.

Panel is upside down so who ever put it in did a sloppy job.

Looks like a shoddy install of a fence panel to be honest. Who wangs a nail through the strut like that making it split.

You're wrong about the ammo. It would come straight from OC HQ with a special customer toilet you can pay £5 to personally load.

I don't want to give in as he will probably take advantage in the future and that simply isn't happening.

Its just a treated lat, buy some from a builders yard and get the joiner to fix it for the 5mins it will take him. You don't need a new panel though, that's just wasteful when you can build a whole new panel using 99% of the materials that are already there.
