Hi, I bought some trainers on eBay that were advertised as new condition, I requested some pictures of them because there wasn't any on his listing, he sent some and I said they look like they have been worn... he said only to try them on. I believed him, paid him less because of them not being in new condition(all done through eBay) they have turned up today and look very used, the toe is coming away, he cleverly took the pics disguising that. I have requested a refund through eBay, he contacts me still saying he only tried them on and are in perfect condition. He has offered me a partial refund of £13.95, I paid £40 for them. Will I get my full money back if I decline his offer?

I started one saying that they were damaged. That's why he offered me a partial refund, he also is trying to say that I don't like them and I am trying to get my money back which isn't true at all.

as above. open returns case saying they are damaged/not as advertised. add pictures of the damage, decline his partial refund, he'll have no choice but to accept the return (ebay should provide the return postage label), or just give you a full refund. Or he can be a pain and drag it out so ebay have to deal with it but that can take a while for ebay to get involved.

Just follow the standard ebay process. It isn't actually possible to drag it out. Everything has timelines for responses. If the seller is being a tool, then stop getting stressed and just speak to ebay from now on.

You'll get your £40 back.

Remember to leave negative feedback afterwards.
