Fighting Peugeot Warranty

Right, OCUK, I need some warranty help. Never been here before when it comes to brand new cars. Brace yourselves, this is gonna be a long one!

Back early in the year I decided to try and park my 208 in a bollard. It didn't end well. Having the textured "Icy Silver" which can't be blended, I got the bumper and entire passenger side (including door so it matched) redone. Alls well. While at the Peugeot approved bodyshop, the painter discovered a seemingly known issue he had heard of; the spoiler not aligned properly causing the paint to be chipped away when shutting the boot. I was informed this will be covered under warranty and will require a respray of the drivers side (as mentioned, it can't be blended)

This claim was originally put in since April. Since then, the same has started occurring very slowly on the passenger side too:

With this paint, it's quite hard to match the texture, and the bit I got done isn't as rough as the rest of the car, hence why not as much paint has been chipped. At this point I have complained and stated that if both sides of the car need doing, they might as well do the entire thing so it has the same texture.

Now nearly 4 months later of Peugeot warranty and the body shop arguing between each other, I get cc'd in an email to the service manager at the dealership (who deals with the warranty claim) from the bodyshop:

...I have however explained to each of you that, due to the processes involved with this paintwork and the unwillingness of Peugeot to honour the repair times they specify in their training for this specialist finish, work on Mr. Carrot's car is not cost effective. We are therefore understandably not particularly inclined to want to undertake any further work on the vehicle.

However, we always endeavour to try to assist and so will re-estimate when we see the vehicle and will await Peugeot’s cooperation before committing to proceed with repairs.

Having discussed with the bodyshop further, it sounds like Peugeot have approved respraying the drivers side, BUT NOT the door, so it will look silly and won't match (which bodyshop have told them). Furthermore, they won't cover the passengers side, saying as this has been repainted by the bodyshop, they have to do that under their warranty, even though it's quite honestly a Peugeot part (the spoiler not being on properly) causing the damage. Obviously the bodyshop are quite happy to wash their hands and just walk away.

Where do I stand on this? The car turns a year old next month and I'm not particularly happy. It was bought with cash. It seems Peugeot will not pay extra for it's own specialist paint. Am I being picky asking for a full respray? Where can I go next if I get nowhere?
 
As its been repaired by their own approved body shop they should have course cover this under warranty. However as its been damaged it's likely they will drag their feet or simply refuse to cover that side and I doubt you could force them to do so without spending a lot of money fighting them over it.
 
Well wonders never cease, apparently you've found a body shop who believe in doing repairs correctly, but Peugeot obviously don't want to pay them for the time it takes to do it properly.

I have a feeling that this would get solved with a strongly worded letter to the Peugeot dealership with litigation to follow if it doesn't start moving forward
 
So basically manufacturer are arguing with their dealer over costs. Dealer understandably doesn't want to complete a job that the manufacturer won't pay them for.

If it was me I would be emailing the MD and putting the issue all over social media.

You could spend time trying to escalate it to the next level in the hope it lands on someone's desk who has a grain of common sense, but given the email you have been copied into I think you would be wasting your time.

I think going up the chain is best next hope, it's just frustrating to be in the situation. Shame no one from Peugeot is on the forums :p
 
Just send 'last chance' letter to dealer that you bought the car from or whatever entity the warranty is with. If they don't get moving in a month then get 3x quotes for the work and give them another 'final chance'. After that pay for the work and then file a small claims action to cover your losses.

They could also drag their heels as well but it could be upgraded to the high courts. Then get the bailiffs involved. However a lot of new cars wouldn't be the dealers they would still belong to Peugeot. Best option would be to get proof from the dealer, their exchange of emails showing they aren't willing to honour their warranty. Then file the claim directly against Peugeot instead of the dealer. Once a claim let's say for talks sake is £4k after all court and high courts fees added. Their head office would pay up pretty fast.
