Hmm ebay ? What to do

I sold a print head on ebay and the courier lost it .. worth about £250 . Courier has been fine etc but buyer not so much . Anyway after they confirmed they had lost it i refunded the buyer .

Now the twist .. They found it and delivered it .. So now no compo from the courier and buyer got a free printhead.. What do i do now ? I obviously emailed him but where do i stand
 
How did you refund him? If through Paypal/ Ebay you could probably see about opening a case and they may reverse the transaction and return your item to you. However as you have refunded him yourself I'm not sure where you would stand on this. Hopefully the courier can provide you with a copy of his signature etc.
 
If it is true that you refunded him on the understanding that the package was lost, which later turned up and he kept it - if he's not going to return it and eBay won't help - I'd probably get a solicitor to write him a letter threatening legal action - if he doesn't comply, small claims court and let a judge decide.
 
Ok thanks all. Its a Business and only 60 miles away so i can always drive and go ham on his letterbox . I will see how he reply's to my email
 
The goods are yours, you'll need to arrange to get them collected. If he refuses to co-operate it basically theft.

Yeah by accepting the refunded money the buyer accepts that you weren't able to fulfil the contract and the goods now either belong to the courier or the seller depending on the situation with the insurance. The buy either has to decide if they are accepting the money and being put back in the original position before the contract was entered into or accepting the goods or its small claims time.
 
The parcel was already 7 days late . it would have took 2weeks for Hermes to investigate . Hardly fair to make the buyer wait that long
 
No, the buyer would have been refunded only when the courier has paid up, normal is now the guy could be out of pocket.

No the contract for the purchase is between seller and buyer, the contract for the shipping between seller and courier

There is no relationship between the 2. If item doesn't arrive seller refunds, anything to do with the courier is of no concern of the buyer, that's the law it's not a matter of opinion
