Insurance claim - third party rights

After 18 years of trouble free motoring I managed to do a very silly thing and smacked into a colleagues car in the works car park. I managed to do quite a job on it and I honestly think it will be written off due to the age of the car (04 plate IS200) and the extent of the damage (I'm sure the assessor will say it needs a new door).

I'm pretty gutted for the guy as it was my own stupid fault and if I had my way I'd have said get it sorted and I'll cover all your costs. Unfortunately I was driving a company car and it has gone through the insurers.

As he is a non fault party can he insist that the car is repaired even if my companies insurer wishes to write it off? His insurer put him on to a claims management company so he is currently in his like for like hire car... a 67 Plate 540i. So the rental costs alone will exceed the value of the car.

Any advice appreciated :)

Nope. If they want to write it off, you have a very hard up hill battle to get them to decide otherwise.
 
If the cost of repair is not economical based on the insurer's margin (could be 60% as an example of the market value of the car), then the car will be written off as a Cat D. Been through this before with my own car.

Buying back as salvage is an option.
 
I can't see how it would be. I've put a big dent in the drivers door but haven't damaged the sills or any pillars. Door still opens and closes fine, lock and window works etc.

So if its written off it will be a Cat N, (non structural damage), so he can buy it back and do it up himself...
