Separating from my wife.

Some free advice here:

If your joint account has money in. Withdraw it now. Then tell them you have separated the next day. They will freeze the account.

Don't worry about being made to pay for it either. My ex withdrew £600into overdraft that I paid off with the expectation court would make her pay at least half of it (given I proved the account was solely hers minus a single withdrawal by me in 2yrs. The judge claimed it proves nothing and that its not a concern.

I also know a person who emptied their joint account of £4.5k and she was never made to give the money back or down the middle because they were unable to prove.

Marriage creates an entity/asset group that is solely there to be carved up if something goes wrong and by getting married your are submitting by default to the Matrimonial Act 84. That is a disgusting piece of backward legislation.
 
Couldn't you try put your assets into something physical and keep it hidden away without declaring it on paper?

I mean if they're going to milk you might as well stick what you are expected to give her into something and risk it anyway.

Problem being that the other half will know what assets there are and her solicitor can then do some digging!

I get that, but if he keeps it quiet and does it right they can dig all they want and i'm pretty sure they wouldn't find anything.

It would be her word vs his.
 
They are, as long as they are still relevant. Though define relevant.

There are multiple hoops to jump through, one was thrown out as it was claimed the wife didn't understand what rights she was going loose by signing the contract before marriage.

Marriage is pointless these days anyway, fantastic if you want your assets raided and left with nothing. Not much else.
 
Our divorce took approx 7 months. Wife wanted everything in the beginning. She didnt want to share the inheritence she was left. In the end everything was split 50/50.

I read 2 pages. This thread boils my ****.

Definately going to get a prenup / not get married.

What happens if instance I have a house, do not get married but have kids - would the woman be entitled to anything if we split up? Need to work out if I even want kids if they cause these problems (problems in our broken system)

Would you want her to have nothing in the event of a split?

Don't get married then, cause prenups are American and worth sweet FA in UK court of Law.
 
Marriage is an outdated institution anyway. Why anyone would want it is beyond me. Most marriages end up like the OPs anyway in this day and age.
What is wrong with just being together and not signing some paper and spending stupid amounts of money on something that the majority of the time is doomed to end up failing and causing more money/stress later on down the line.


Pessimistic I know, but true.
 
If she contributed nothing at all, then no. I would always want a fair split

I am not agreeing with what the law states, but if you have kids, then where do you expect them to live? You cannot just turf them all out into the street with the missus as she does not work.
