Bought item, no red card returned to sender now destroyed

Hello guys

I bought a smart watch, well two as they were on offer for £39 from a known site that ships from China. It took about a month and only one of them came, I asked their support and they said they had to ship out one then the other but the other was going to be on its way. My other one came (Easter present for girlfriend)

They sent it out (my one) I never did receive it. After asking for awhile they gave me the tracker and by then Royal Mail had sent it back to the return address. I tried calling Royal Mail and they couldn't do anything.

I was never left a red card either???

I told the vendor this that it's going to return address but now today it's been destroyed.

They made a refund offer...

I don't fully understand what they are refunding? 20% of my £39 or all the £39 minus shipping? I ideally would like a reship of the watch and just pay the shipping costs or full refund.

Can I argue this with Royal Mail as they never carded me?

Thanks for the replies. I didn't use Paypal as my account doesn't work. I used debit card payment but I think Paypal processed it. I know its destroyed as the vendor told me today and I think the tracking would have said that.

Should I ask for a 100% refund minus the shipping? to the card or even store gift.
 
You paid for an item to be delivered, you didn't receive the item - it's not your problem and they should refund you in full.
 
No they shouldn't.
As far as they know delivery was attempted and he never went to collect it.
His beef is with royal mail.
If they, gearbest, offer you anything it's generous.

This is the gamble of buying vat free from China.

The item was never in his possession, and to collect it from the Post Office he would have to have taken identification before it was signed over to him. As the buyer he has no contract with the courier, the seller does. Maybe it works differently in Sweden.

No idea how it works in Sweden.
If royal mail have attempted delivery and "left a red card" isn't it in tony's court to collect it?
If it's then later returned to sender are you saying that you should be fully refunded?
Is everyone forgetting it's a Chinese company that probably gets ripped off 100x a day?
Why also does a foreign company have to comply with expected British rules?
Did he say he used Paypal? Cos that's about the only thing that would get him a refund I think...
 
If it contained lithium ion and wasn’t declared as such (as is probably the case with Gearbest) there is actually a chance that it was destroyed by carrier, however that isn’t the fault of the recipient.

If it was destroyed by RM, the tracking would also state this.
 
Here this is weird, but its nothing to do with you as no one has any proof that you touched the item, the vendor should refund you in full and then deal with the courier.

Eh? Their beef is with Royal Mail, Royal Mail are acting on behalf of the seller not the buyer here. The seller (and their agents) have failed to deliver, they should sent another or refund him.
