Sec.75 on eBay via credit card

Does anyone have any experience with Section 75 claims with ebay purchases made by credit card and not a paypal account?
The transaction on my statement still says paypal as I belive eBay use paypal to process the transaction when not using a paypal account and it subjects you to these terms: https://www.paypal.com/uk/webapps/mpp/ua/privacywax-full?locale.x=en_GB

I've asked my bank to investigate it further however their initial response was that as it's paypal it's still not eligible. Seems to be that purchases like this leave you in no mans lands when it comes to consumer rights.

Yes, listed as "Paypal *MERCHANTNAME" hence why my bank believes it's a paypal payment even though it wasn't made via a paypal account.
I'm hoping the bank will come good tomorrow and see the difference but I know I won't be so lucky.
 
You can pay by paypal without having a paypal account. If you click the signup link from the email receipt you can create an account and start a claim. You might be able to do it through ebay too?

It doesn't qualify for section75 because your complaint is nothing to do with the transaction on your credit card. You paid paypal from your credit card and paypal paid the seller. It's the transaction between paypal and the seller where you have the problem, not the transaction between your credit card provider and paypal so they dont have to help you (but some people have had success with it)
 
Keep at your bank. A CC transaction will have come into their system with different codes to a PayPal transaction so whoever is telling you they can't is fobbing you off or clueless. Escalate it to management if required, just keep telling them it is a Purchase transaction on a CC.
 
That is odd, pretty much all credit card payments will pass through a third party (in-store and online) so for it to be a lottery as to when section 75 applies is ridiculous.

OP I take it your claim through ebay failed for some reason for you to be going to your credit card company for assistance.

The background story to this is that I purchased a monitor from a competitor via ebay in December 2017. It came with a 3 year warranty(AOC).
I sent the supplier a video of the fault and reported that it wasn't happening all of the time it can come and go but it was probably happening twice a day for me.
Said supplier said yep, send it back to us. They've had it for a week and are now saying that there is no fault so just want to return it to me.

It may be that I try my efforts going direct to AOC for resolution.

Yes, but "no protection under section75" is not the same as "no protection". In my experience, Paypal buyer protection is much better and less hassle than a section75 claim.

It may be but under the method I used then you also don't receive any paypal protection either as you do not have an account with paypal. You then fall onto ebay protection which is only 90 days.
 
Guys, Credit Card payments on Ebay are processed through a Guest Paypal account. You are NOT protected under Section 75.
 
Unrelated to ebay or paypal, but Also worth mentioning that Amazon marketplace transactions are also exempt from section 75 (for reasons I can't remember right now but I looked into it a few years ago and it was correct).

Section75 requires a direct payment to the supplier of the goods/services in order to cover the transaction.

Any payment you make which involves a third-party in between (eg you use your credit card to pay paypal who then send the money to the end supplier) isn't covered.

I wonder why PayPal is seen as being different to any other payment gateway as all online stores use some form of third party merchant service to process card payments.

As do card readers in stores now that I think about it.

A paypal transaction is different from an online store using a payment gateway.
On your credit card statement, a PayPal transaction shows as you having sent money to paypal. A normal transaction will show on your statement as the payment going to the merchant regardless of what payment gateway used.

If you have a read of the MoneySavingExpert link posted above you'll see it is currently impossible to know at the time of purchase whether you will or will not be covered by Section75.

Even the Financial Ombudsman Service (FOS), which arbitrates Section 75 disputes, is unable to provide clear guidance. It says buying from a retailer using a third-party processing firm will void your usual Section 75 protection in some, but not all cases – and it won't say which type of payment is or isn't protected, leaving shoppers in the dark.

How does that work for company's that use PayPal as a Card Processing service. What makes PayPal any different to Worldpay, stripe or verifone?

What company doesn't use a 3rd Party to process their card payments?
