(If they don't say anything of the sort and you are basing the purchase on your own inspection only, and no description from the seller, and then you discover various issues, then I agree with you entirely, that is different. We are talking about if the seller -expressly lies about something-)

What an unhelpful silly immature post from that forum member after I’d been helpful to the Thread.
This is why when selling a 2002 Vectra recently, i just said nothing other than "this is an old car, which i nearly just called into scrap, but believe it to be better than that, it seems to run OK to me, but please test it in any way you please and be sure that you are happy with it". If they asked anything i just said "this is a very old car, please just test anything you wish, i am not guaranteeing anything about it"

Quite why anyone would try and mislead over such valueless cars is beyond me in the case of the old Saab above.

Yeah, i was amazed. A whole car for the price of a couple of tyres on my proper cars, and he was commenting that it had minor oil leaks showing on the block, etc. Im there just thinking that its a _whole_ car for £500, you should be amazed that it has 4 wheels and an engine! :p
 
Yeah from what I know of the situation it was issues that became clear almost immediately and the vehicle was taken to a garage who then confirmed the costs to get it roadworthy.

So, there's a difference between unroadworthy and failing
an MOT. If you have sold an unroadworthy vehicle, then that's a criminal offence under s75 of the Road Traffic Act

How can that possibly be true? The ancient Vectra i sold recently, clearly not stating that anything worked and that its a £500 car and they need to make their own mind up. How on earth could i be liable if that thing turned out to have a dangerous fault with it?

I also sold a write off (as a write off!) a few years ago, after buying it back from Admiral as i knew the thing would be worth more than they asked for. That car was obviously not roadworthy, one of its front wheels was at 90deg with no driveshaft attached to it :p

Indeed, even allowing for the clause that says:

A person shall not be convicted of an offence under this section in respect of the supply or alteration of a motor vehicle or trailer if he proves—
(a)that it was supplied or altered, as the case may be, for export from Great Britain, or
(b)that he had reasonable cause to believe that the vehicle or trailer would not be used on a road in Great Britain, or would not be so used until it had been put into a condition in which it might lawfully be so used,

which covers you if you are selling it clearly as spares / repair, but surely your first example happens all the time, i.e. someone selling an old banger in good faith and it transpires shortly after that it has a fault deeming it unroadworthy? I can't imagine the courts are awash with cases of this?!
