The nervous wait to exchange....

The house we're buying is also empty, guy went into hospital earlier in the year and didn't come back out - Very heavy smoker (all walls are yellow, place stinks, it's gross actually, but is big and has huge potential). Probate is taking ages to be granted though.

We have 2 months notice on our rented place. Don't want our landlord getting whiff of us leaving though in case dates don't line up/things fall through and we're left homeless so we'll just have to pay rent + mortgage for 2 months.

Ah yeah probate will certainly add some complexities into the timescales!

How come 2 months? Is that till the end of your fixed term contract?

From all my reading, under AST rules in England the rentee only has to provide at least one months notice, whereas the landlord has to provide at least two months notice.

2 months is what I saw in our contract. I'll have to check again.

We only have yearly rent agreements which is up next month, was rather hoping we'd complete in Sept so we could just not renew but that's looking very unlikely now, so will probably have to sign another years contract then pay to live in both when the time comes to completing.

You shouldn't need to do that at all. At the end of a fixed term contract, most will move onto a SPT (statutory periodic tenancy) - essentially a rolling contract, you don't renew the tenancy, it just carries on. The only difference is that there's less security from a tenants point of view.

Some of the wait times to move are mental, recently bought and sold. Total time from my house on market to moving into the new house was six weeks. My lawyer is a friend of mine and she does not mess around, conyeancing is her forte. The buyers lawyer was getting a bit fed up with her constantly pushing for replies.

Anyone around the lanarkshire area need a lawyer for house move drop me a pm and i'll forward you her office number!

Thanks, just had a read of that, the issue is though, if we say we'd like to rent on a monthly basis he could just say no, I want someone for 12 months, get out and that's that....

At the end of the day your lawyer/friend can be as good as they like but you still need the stars to line up when it comes to the rest of the chain be it conveyancers, clients, banks, landlords etc...

This has been one of my worst fortnights ever for totally uncontrollable things ruining people's moves. Everything from property damage to people dieing :eek:

I can agree with this. My best friend is head of conveyencing at his firm and the crap he gets given from other parties. Latest example:

Landlord emails my client ‘your solicitor hasn’t sent us what he needs to do is delaying matters’
Me to landlord - no problem just tell me what you need
Landlord ‘with respect it is not for me to tell you what to supply. We have told our solicitor who will tell the sellers solicitor who will tell you’ -
At this point, he's received nothing in that regards.

On my sale and purchase he's been ready and waiting for over a week just for the basics from Sarah Mains, who are moving like molasses just to give him the memmorandums of sale to get both houses off the market.

I did go through a phase of posting in here the kind of situations I deal with but got pretty sick of just being lumped in with the useless conveyancing crowd on a regular basis.

For every terrible conveyancer there is an equally terrible client. I've been leaving several voicemails and emails a week with one of my clients since June trying to get ID documents and they just don't respond. The one response I did get was a photo of a passport where only about a quarter of it was actually visible :D The sellers are blaming me and I know this because they've contacted me directly on more than one occasion but what more can I do short of go round to their house and get it myself (which I would actually consider but they're at the other side of the country)? Madness

I think what's held ours up a bit is that the vendors left a gap in the property information form, and one of the questions has something about will the proceeds of the house be used to clear the mortgage or something similar. Both have caused our solicitor to raise these as extra enquiries. It's more annoying than anything because their solicitor should have flagged this up with their own clients when they sent in all the selling paperwork.

That's such a common incorrectly answered question, at least 10% of people get it wrong and I have no idea why, it's not even complicated! Not something to hold things up though simple matter of was it a mistake yes/no and will all charges be repaid on completion yes/no. Negative equity is so uncommon its pretty much a non issue.

As for people dieing... Thankfully only one died so shouldn't need to wait 3 months for probate!
 
Tell me about it as far as holidays. My wife is a teacher and we have 2 kids. We had expected to be in before the summer holidays and with a whole catalogue of issues including our buyers having to get a deed of variation sorted as they are selling what’s known as a tyneside flat and some fuckup in their deeds. our dates have pushed back and back and now >6m. We have spent most of the summer holiday in basically a fully packed house being told things could shift any day and move. If we had known we would have unpacked again

Thank god this is the forever house as I don’t think my wife could consider this all again. Hopefully in next 2 weeks.....

The sellers are happy to wait for us to sell our houses (Reality is we only need to sell the bigger one to cover costs) - thinking about it, Christmas is probably a bit too ambitious as we've not got any firm offers on the property in Kent and the second house should go online in about 2 weeks.

I just hope you don't get strung along by people on your properties who then pull out, much better system up in Scotland IMO.

Very nice house, you'd spend over a million for that down south!
 
Cheers for the nice comments. Yep, one thing we've realised is that £380k-£550k can get you some serious houses, in some cases mansions. The value for money is astonishing and as mentioned, if you wanted something in the South East, it's going to cost mega bucks. I think we did well to get it for £430k despite the offers over bit. The home report has value at £450k and the insurance estimate is £750k if memory serves.

A beautiful building, but ALL windows were knackered and needed replacing, despite the HR stating a couple and we were told that virtually all around the property is now covered in a new development, 3 of which would overlook this property. We were a bit narked about not being told this before going up.

Ridiculous :D

My Aunt has just purchased something a bit smaller in size to link #1 for just over a million and that needs a ton of work on it.

It's in Kenilworth mind, overlooking the castle, but still, shows what you get for your money up north!

If only there were jobs....
