*** NVIDIA GEFORCE RTX 3080 SERIES STOCK SITUATION - NO COMPETITOR DISCUSSION ***

Nope apparently a new shipment left the factory on the 14th, could be your lucky week next week
My prediction goes out to week of April 5th for ASUS TUF non OC. However, with two weeks lost due to CNY, it will likely be towards the end of April rather than the beginning. That is if ASUS keep the numbers up that they have been shipping over the last few weeks and people keep cancelling.

A post on reddit has summed up what gibbo said and why they not keeping the queue system open.

A guy couldnt get hold of ocuk on the phone for multiple hours no answer, are people really ringing just because they cant wait?

Also in this queue, and I have come to the conclusion that OCUK is unlikely to get any cards in the XC3 line until at least unnamed main competitor has cleared all their back orders.

Simple case of preferential treatment by the supplier of one retailer over another. We may never know the reasons for that but safe to say we backed the wrong horse.

I have a friend in a queue elsewhere who has been offered an EVGA hybrid card for £120 more...
I wouldn't pay more for my card especially one that wouldn't fit in my build!

I'm pretty sure it's against the consumer contracts regulation to do this because of the following -
  • the total price of the goods, service, or digital service or the manner in which the price will be calculated if this can’t be determined
  • how you will pay for the goods or services and when they will be provided to you
Failure to provide the required information, or to provide it in the way set out in the regulations, could result in cancellation rights being extended by up to a year.

The information should be given in writing in a 'durable medium' such as on paper or by email.

Alternatively, it can be provided in a way appropriate to the means of communication, so verbally if the contract is made by phone.

You are also entitled to confirmation of the contract and if the information wasn’t initially provided in a durable form, the trader must provide it at the point of confirmation.

Directly quoted from the consumer rights website.

Though there is little on this other than you may cancel the order legally if these apply to you! It does mention that changing the contract once something has been promised is a no. Though I guess its down to wording, its an 'offer' not a demand!

Sorry for the spam, it's undoubtedly going to get me banned! Because 'bad press' but if I do then I actually have a case because of the 'Unfair trading regulation 2008'

What is unfair?
Under the Regulations, a commercial practice is 'unfair' if it fits both of the following requirements:

  • It falls below the good-faith standards of skill and care that a trader in that industry would be expected to exercise towards customers, and
  • It affects, or is likely to affect, consumers' ability to make an informed decision about whether to purchase a particular product
A trader will be committing an offence under the Regulations if he knowingly or recklessly engages in an 'unfair' practice.

A trader will be committing an offence if it does any of the following:

  • omits material information that the average consumer needs, according to the context, to make an informed decision about a transaction
  • hides or provides material information in an unclear, unintelligible, ambiguous or untimely manner
  • fails to identify that a transaction has a profit-making motive (where this isn't already apparent from the context)
Information must also be displayed clearly - obscure presentation is tantamount to an omission.

The list of banned practices includes the following:

  • Bait advertising Luring the consumer with attractive advertising around special prices when the trader knows that he cannot offer that product, or only has a few in stock at that price.
  • Bait and switch Promoting one product with the intention of selling you something else
  • Limited offers Falsely stating that a product will only be available for a very limited time, or that it will only be available on particular terms for a very limited time, in order to elicit an immediate decision and deprive consumers of sufficient opportunity or time to make an informed choice.

New right to redress
The Regulations give you rights to redress - if you've been the victim of a misleading action - for example a false statement - or aggressive selling.

These break down into three key areas
A right to undo the contract
A right to a discount on the price paid
An entitlement to seek damages

My argument would be, can I make an informed choice with no information?
I think OCUK is treading close to the line here, as ommissions aren't covered under the redress policy.

OC UK have been providing info when they have received it from their distributors. No info at any given time means they haven't received word. All OEMs atm are struggling to supply GPUs and you have to factor in that multiple stores are all competing for the stock for their customers. It really does suck but at the end of the day we only have two real options open to us. Stay in a given queue until stock arrives or cancel our orders.
