Just been given my 1st Section 59 For Going over 3k revs?

5.5k peak in gear 1 on the upshift. Let off at 40 in second, then shifted up to 5th.

Because that's how people normally drive on a dual carriageway.

Are you telling me you never go over 3K revs when accelerating away?

I have not stated anywhere in this thread that this is something I do every time I drive the car. I am surprised that so many people are jumping down my throat for utilising the acceleration of my car in a safe manner without breaking any laws.
 
Lol I appreciate all the humour in this thread, but does anyone actually have a serious response? Is it worth me liaising with a solicitor or would I be wasting my time?
I guess everyone figured you could probably Google 'can I appeal a section 59?' yourself, rather than them do it for you.

It's not exactly a forum full of people who have experience in getting section 59s is it? :p

I did Google and most say there is no appeal process with a minorty of places saying you have to appeal via the chief constable of judical review. I thought someone on here might be able to provide clarity.

I know people who got pulled for drifting around roundabouts and never got section 59.

It's either there's more to the story or the op needs to go seek clarification as to why he was given that.

And lol at a few of the driving god's here... Too many Mr perfects on the internet never having any fun in life.

These cars are designed to have fun in and accelerating up to the speed limit is nothing.

To me it sounds like a Bobby that had nothing better to do and felt like giving you section 59 for no reason.

Guess my s2000 getting up to 9000rpm is equal to drink driving in his view.
 
Section 59
Section 59 of the Act is a common tool now used by police constables and police community support officers (PCSOs) to seize vehicles being used in an anti-social manner. Vehicles can be seized if the police officer / PCSO reasonably believes that a mechanically propelled vehicle is being used in a manner:[5]

  • causing, or likely to cause alarm, distress or annoyance to the public,
  • and:
Vehicles should be issued with a warning first, unless this is impracticable.[5] An example of it being impractical would be the offenders leaving the vehicle/making off or the vehicle being unregistered and unable to be traced - therefore a warning unable to be placed. If an officer also reasonably believes a warning has been given within the past 12 months - whether or not recorded on the Police National Computer or similar system, they can seize the vehicle immediately.
 
I get "sporty" exhausts and I get having a loud can if you are a biker for safety....but the current obsession with cars that pop and bang on their maps is just embarrassing.
 
If the OP was doing nothing silly or illegal and in a factory car then this officer of the law has had a major over reaction!

Us S2000 owners would be doomed considering we have to rev our engines over 6000rpm to get moving.

This police officer would hate my cars two of which Rev to 9000rpm and are factory standard and I rev them that high every time I drive them on the road.

What about a motorbike that revs to 16,000.

Police should not be aloud to give out section 59’s but as I’ve never been pulled over in any of my cars which are all factory loud and some modded with exhaust so louder again but I’ve never had an issue from the police.

So the OP either got extremely unlucky or his driving was somewhat questionable. When it comes to pops and bangs my SVR was obnoxious loud and did it every time lifting off so these are factory legal cars and if not being driven like an ass or speeding then police should not be giving out tickets.
