Just been given my 1st Section 59 For Going over 3k revs?

Whilst I do like winding you up a bit, if you are being entirely honest then it seems you have been a bit unlucky to get the S59 for nowt, officer could be having a bad day or summat and as your car is naturally ASBO decided to take it out on you! Not that it's justified of course, even if it is an A45 D with M-sport S-line aeroplane package...

Might be worth making a complaint to their superiors, though I wouldn't expect much to amount from it.
Haha, I am considering putting a complaint in. It's just a case of is it worth the time and will it go anywhere. When driving I will be thinking If I drive over 3k revs I will have another section 59 on me and the car seized?

Were you cheeky about refuting the 55 in a 40 accusation?

Giving you the benefit of the doubt and assuming everything you say is accurate, I’d guess he probably didn’t like your attitude and just scrabbled around to find something to throw at you.

I must admit it’s not something I’ve come across before but it seems crazy to me that you can be issued something unilaterally by an individual police officer with no obvious or realistic recourse for appealing it... Where’s the accountability in that system? Even the most ardent lover of the police must admit there are going to be a few that get it wrong every now and again.
I think I passed the attitude test. I simply stated "I was not doing 55", and said no more regarding the speeding accusation. I was polite, perhaps too polite. It was PC Plod rather than a traffic cop.

my money is on the op giving it stick off the roundabout in full on yobbo settings holding the revs manually for extra pops bangs and cracks etc plod clocks him acting like this can’t get a effective speed reading to do him for speeding so hands out a s59 instead.

But op you can appeal a s59 directly with the chief constable fire a short factual letter off regarding the matter it costs you nothing and be aware the s59 doesn’t mean your car will be crushed only removed from the locality ie siezed but you would get it back
The car is rarely in comfort mode as the throttle is very laggy in this mode. The car was in sports plus in auto mode. The 5.5k shift point was an estimate based on the fact I was not full throttle, the car only shifts close to 7k when you are WOT. I didn't give it stick from the roundabout, the thing is the copper wasn't even directly behind me when I left the lights, he came from the right hand line and must have overtaken 4 cars and been speeding to get right behind me.

Just out of interest what type of police officer was it? A traffic officer or a PC in a astra or something?

I've had a section 59 years ago for something similar but I'd imagine at a much much slower rate and with some utterly pathetic wheel spin (I'm talking about a N reg 1.4 Seat ibiza here, all the power!)

I was stupid for a few years when I first got my licence and I've been pulled over many times, typically I find traffic officers don't throw things like section 59's about unless you are bang to rights, but pc plod is more than happy to on a whim.

Did the officer notice the starlight headliner? That might have swung things in your favour.

Why would he want to void his warranty on a factory car, the OP if been truthful has broken no law, he has a factory standard car and was not driving over the speed limit so the S59 seem incorrect and the car is factory so I’m sure the owner does not wish to invalidate his warranty on a 40-50k car. Screams of Plod abusing his power due to a bad day or jealousy!

as much as i would like to agree with you if the same said copper see's him at it again it could end badly for the OP.

For clarity, the copper asked if I had a "pops and bang map" to which the answer is no. My car is modified (Performance Remap, Some interior modifications etc), but this is all declared to insurance, and not what the copper asked.

It does feel like a law of unintended consequences going on here: a tool to deal with with barry boys and their chav rockets could be misapplied to anything sporty with what seems to be no right of appeal. I'm remembering videos of either Gibbo's SVR or Kindai's lambo (or possibly both!) being more than a bit noisy in that tunnel through the middle of stoke. Take this forward 10 years when the majority of cars are whisper quiet electric, does someone with an ICE get done, just because the plod has a bad day.
 
Seems like they might be getting some practice in for when they inevitably ban pointless noise pollution being made. The daft thing is the excess noise offers no performance just makes people pay more attention, quite why MB or any manufacturers think this is good I have no idea.

Write to the local constabulary, explain you feel victimised, and that your car was designed to sound stupid from the factory and that isn't your fault, after all accelerating fast isn't illegal unless done in a dangerous fashion.

The car choice is only part of the story. I'm more interested in the lack of any apparent right of appeal. It seems like a "persistent offender" is someone doing it twice and then that's a trip to the crusher. If I apply the right foot more vicariously than normal to "check" I can still reach 60 in ~6 seconds and I'm pulled by a copper who happens to hate old farts in Jags, do I get the same problem ?

OP needs to try and appeal this somehow, and from other posts in here, get a dashcam so he can present his evidence if it happens again. Its his word against non-traffic cop and we all know that copper's word will be taken over his unless there's independent witnesses.

SVR most obnoxious car I’ve owned but totally factory specification and never an issue with police but maybe it’s because a V8 sounds vastly superior to any 4 pot twist and **** popping fart cannon. :D

My mate has a new SVR and he has had pops and crackles out back in as Jaguar calmed it down plus he also fitted sport cats and new pillows and running circa 700HP and gotta say it makes my old SVR sound tame in comparison and he is genuinely worried he has ruined it and gone too far and frightened he will be pulled over, so far so good for him but time will tell.

Your SVR was an event to behold even to non-petrol head types whereas "fart cannon" :D type cars are just an annoyance to most around them.
