Chancel Liability

Shouldn't this type of practice be reviewed now? I mean, for our Gudwaras we donate as a religious or cultural community which makes sense. It doesn't make sense for those who aren't religious etc. to donate to the upkeep.

I understand Christian country and historical etc. but just seems so out dated.
haha yeah I'm fairly sure that if I contributed anything to the structure of any church, there would be an epic lightning storm, an earthquake and possibly a volcano all on the same site at the same time :D

The church still has quite some sway in the UK however

Eventually I am sure its going to fade away. Slowly many of the churches covered by these sorts of thing are closing, eventually they get "declassified"* and end up just as a private dwelling
* thats completely the wrong word, but its as close as i can get. Basically they do something to un-consecrate the ground (actually that may be the right word) and then its just the same as any other land, its usually done when selling.

Yeh I guess, it just needs more time I suppose and potentially some of the more historical sites will get classified as such and fall under a different banner where our tax money will be used for any upkeep lol

Chancel Liability ceased to be a thing in 2014 as it was reformed as suggested above. It can now only bind if the church registers the interest on the title to the property. If there is no notice of the interest on the title to the property you are purchasing you are clear if/when your purchase is registered.

The slight caveat is that the church may be in the process of registering such interest, but in 2021 I have to say that I find it highly unlikely. I have never come across one and it’s my job.

Lots of firms still bang on about it because the insurance is so cheap and easy.

Ah that's great to know, thank you. I'm going to check the docs to confirm. Appreciated :)

Edit: Nah, nothing on the title at all - will get the solicitors to double check but sweet, can ignore it all.

Thanks @Shoza :)
