Main dealer Mis-Sold Car?

Hi everyone,

I am looking for some advise please regarding mis-selling no service history for the car and what are my options -

I am a new driver and recently brought a used car from a manufacturer authorised main dealer. The car is 10 years old and has only two service history record and 8 years is missing - and this was from a main dealer !!

  • - During the test drive I asked the sales person for service history documents and he showed me one or two invoices along with MOT history.
  • - I did not look in detail being an inexperienced driver buying my first car.
  • - However I followed up by email asking several questions with one being that I needed the full service history. This point was responded as yes, we will give what we showed.
  • - Over the next few days, I had asked many questions, followed up and asked a further 7 times for a full service history. Some of those emails were not responded and some were responded as "refer to email from x date" - which was when they said we will give what we showed and another where they said "yes we will give"
  • - At no point were they upfront to clarify that the car has a "part" or "missing service history" in the 8 emails I asked them reg full service history.
I was told the car has a 5 years manufacturer warranty left as long as it is serviced at a main dealer apart from the 1 year dealer warranty.

After I made the final payment, the car was delivered and later the service history was posted. It only had two years history and rest is missing.

I feel I have been cheated and the dealership and salesman were not honest and upfront to tell in advance that the car has part service history. They deliberately hid this fact.
Other than this I am not sure if a dealer can sell a car as "manufacturer approved used" without service history.

Can someone please advise what are my options?

I am still within 30 days and I made part payment with credit card

Can I reject? there is no issue in the car so far, but despite asking for "full service history" a number of times,I now realise it has 8 years of missing history.
The advertisement had no mention of service history.

Manufacturer approved used just means that they have (or should have) done the checks outlined by the manufacturer that the vehicle must pass to be "approved".
It could have no service history, that's not necessarily part of the checks, maybe just that it should have had a service within the last 12 months.
If you are not happy, then reject it. I also can't see how it can have another 5 years warranty on a 10 year old car?

You could reject it, or if you're otherwise happy with it, ask for compensation as a service plan for one or two years. Keep. It kind the lesser value when you resell it due to leas service history.

The 5 year manufacturer warranty is on the hybrid battery as it is a hybrid car. The car is 9 and half year old and the manufacturer warranty left is 6 months. It comes with 15 years hybrid battery warranty
The dealer confirmed today that there is no service history other than what has been given, and no further digital service record.

Aside from the clearly bot/troll nature of the OP, there's some things that don't make sense. 8 years of missing service records on a 10 year old car is vanishingly unlikely to make it through even the loosest of AUC schemes. 10 year old used cars from main dealers are pretty rare anyway, but even more rare are 10 year old cars from main dealers with FIVE YEARS of warranty remaining. I'm calling BS.
 
I asked them to either

- give the full service history or
- compensation or
- replace with similar car

they were amenable to compensation but the amount was far too low than what I was asking.

I asked about returning for a full refund and I was told there is no issue with the car for them to do that. My point has been the car has been mis-sold as it was not labelled as part history and this was not told to me when asked for full service history 8 times on an email.

The other point I have is the manufacturer warranty is no more valid as there is no record of service history and i was told it will have manufacturer warranty.

Does this qualify for it to be rejected?

It is possible someone extended the manufacturer warranty, which may or may not be transferable, usually it applies to the car.

I don't generally see franchise/authorised main dealers with 10 year old stock though - unless something expensive/rare that usually just goes straight to BCA - though since the pandemic and new stock shortages they've seemed to be selling them more - one of the ones I use a bit has a small number of 2011/12 cars though mostly 2015 onwards.

Please read my message above clarifying regarding warranty. and yes it has 8 years of missing history.

I agree 10 year old car from main dealer are rare and hence they said it is difficult for them to replace with something similar. I purchased it as it has very low mileage but now have issues as mentioned in my original post.

How low is ‘very low’? Is it possible that the car has actually only been serviced twice (based on mileage intervals) rather than annually regardless of mileage?

What is the current mileage and the mileage at the time of the services you have details of?
 
The car has a mileage of 22K.

The only record of service is from dealer before the sale and one in 2014. There is no other record.

My preferred option were

- They give me full history --> they say they cant as they do not have it
- Compensation --> They offered a very low number which I am not happy with
- Replace with another car --> They said very rarely they sell such old cars with low mileage so it will be long till they find one

Where I am seeking help is what options do I have from here on?

Can I reject it on the basis that

- Dealer did not disclose the car has 8 years of missing history despite me asking for it in 8 different emails --> the dealers claim is that they never advertised as full service history
- The 5 years of hybrid battery warranty is not valid as the car is not serviced at main dealer --> the dealer said they will check this fact

Anything else like small claims court or trading standards? Has anyone been in a similar situation ?

Come on guys, stop getting trolled, if I owned a car that was 10 years old and only done 22k, it would have been serviced every 12k miles, so there would only be a record of 2 services being done in 10 years...
 
Specifically, what were the email replies asking about full service history and do you have a copy of the original advert you can show us?

If you have been sold a second hand used car, unless it states on the advert or they claim it was FSH than frankly chalk it down to life experience and suck it up.

The 30 day right to reject wont apply simply because you didnt undertake your own due dilligence.

Thanks. Replies state - "we will post it to you" or just a "yes". In person I was told it may be somewhere and we need to find it.

The advert does not state partial history as is industry practice and it did not explicitly said it has full service history. The other point is the hybrid warranty being void without the service and they have confirmed on email that I have 5 years of additional hybrid battery warranty. The warranty condition is that it needs to be serviced from main dealer every year.

Haze, you can ignore and stop commenting if you do not have anything to contribute as it is you who is trolling here.
 
You can search this sub forum for many threads where other members have gone down the route of rejecting cars because of xyz issues.

One key thing you need to mention to the dealer is that you're rejecting the car, not returning the car. The latter implies you'd like to return for whatever reason, whereas the former is exercising your consumer right to reject.

Have a look at previous threads as you'll want to inform the dealer of your intention to reject based on your consumer rights in a written format is best.
 
Couple of things:

Was it advertised with a FSH?

From the comments you have made, the sales guy at no point told you that it had a FSH, merely that you will get the documents showing what services it has had.
