Chances of overturning driving ban?

Your partner needs should tell the magistrate the same things you have mentioned in your OP and make it clear she requires a car for her work.

I was in a magistrates court years ago, one guy was up on a driving offense had well over 20 points in his license already and was up on a speeding charge. He argued that he was self employed and driving was essential for him as he wouldn't be able to make any money (I think he owned a bouncy castle hire company). The magistrate gave him another 3 points and hefty fine but didn't ban him from driving but warned him this was the last time (he also remarked at how expensive his insurance premium was going to be with all these points).
 
You do hear stories of people having 20+ points yet still driving because their license is essential to their livelihood, & its just minor speeding offenses, so I'd say she has a very high chance based on her work/care responsibilities.

Yeah, it's pretty ridiculous that you can "get away with it" on some nonsense excuse. It's not like you suddenly end up with 12 points from a single incident, so if you haven't gotten the message after the multiple "warnings", then should you really be on the road?

Of course everyone speeds occasionally, but if you've been caught multiple times before then wouldn't you be on your best behaviour? It just shows that you either think the rules don't apply to you, or you are so unobservant that you constantly miss the speed limit signs/cameras/vans. Either way not really someone I want to be sharing the road with.

As did we, but it took them 3 months to issue her with an intent to ban and even then it wasn't direct, just that it could possibly be a 6 month ban and that they'd like to offer her the chance to appeal. I couldn't believe what I was reading when the letter came through. So wishy washy.

Have you asked her why she does it? Like. Is it some mental block? Or she just doesn't care? Or she doesn't register? If she's not just an *** there surely must be a reason?

Only people I've known who've been banned have either been aholes or speed freaks.
 
Apologies, they haven't al been accrued in 3 years, just the last 6.
Then she must have history as points come off our licence after 4 years. Not only that but if youre doing 24 in a 20 you'll be offered a course so she's obviously been caught for one more instance then youre saying.

You need to check the date on the letter because there is no way they take months to send a speeding letter. I would have thought if she drives often she would have been pulled over because the reg would flag up.

You appear to be making excuses for someone who cant drive safely.
 
Legal rep costs about £1300 which we just don't have at the moment.


I have an array of mangled engine internals above one of the benches, a little "Black museum", with a sign blow saying "Speed costs, how fast can YOU afford to go?"

Might also be appropriate here...

Freeman's No.2 got me off 118 on the motorway once, even back then YEARS and years ago it cost me a lot more than £1300.
