You don't need an active website to hold a domain name for speculation per se though it can help establish that it's not been registered in bad faith - simply having registered it before the trademark existed is sufficient to demonstrate that though.

You can't infringe IP when registering a domain name, so that leaves you with the generics, which as someone else pointed out, aren't that good for recognition. That's why I decided not to pursue it.


Yup, though you're not confined to generics - it's more just whether a unique, trademarked name exists *before* you registered/owned it.

Like if you registered deliveroo.[whatever] then the existing owners of deliveroo would likely object as that already exists and is unique, but if you by chance happened to have speculated that some unique name might be valuable and registered it then some other company establishes that name as a brand on a different tld then your registration isn't in bad faith as it's before their trademark existed - they'll need to pay you for it, you have no obligation. On the other hand a third party buying the domain from you might not be covered as it could be seen as bad faith and they'd be vulnerable to UDRP as they've bought it after the trademark was established.

However, a good generic domain sale can still be made, e.g. the recent sale of wisdom.ai for $750,000


It seems do-able, but the reality is it's very hard to do now.
