36 in a 30 - take the hit?

Would you happen to have a copy of the original NIP you could show us? I've lost count of the number of people who've told me they've been caught at 31/32 in a 30, so far not one of them has been able to show any proof.

It is because it doesn't happen. No one is going to try and do you for 1mph over the speed limit because they know full well that they could not prove beyond all reasonable doubt you were speeding. That is why 10% + 2mph guidelines are used because whether you argue there is a small margin for error or not, you will still have been speeding.

Exactly. My car read 1mph over apparently, at 70. Pretty sure it's almost bang on at these slow speeds too.

My car doesn't really overread at slow speeds but at indicated 70 I'm actually doing about 66 if I sit at indicated 75ish I know I'm doing ~71

I have no idea where it is as I have moved house since then. If you don't want to believe me then that's fine, but I know how fast I was going and what the letter said. I would look for it but I really can't be bothered to waste my time.
 
I would love to see one. Not that I don't believe it, it is just that I have never seen one less than 10%+2. If someone did show one it would disprove one of the biggest assumptions/guidelines used by drivers.

I was going to post the same as you, almost word for word. Genuinely interested to see one.
 
The thing is, if I ever got a 32 in a 30 zone, I would personally take it all the way to court. It'll most likely be thrown out as wasting police and the judges time for such a petty thing.
 
I don't believe the 32 in 30 either. Every force I know of does 10% +2 as their threshold so 35 in a 30, 46 in a 40, 57 in a 50, 68 in a 60, and 79 in a 70.

The Association of Chief Police Officers (ACPO) has issued speed enforcement policy guidance, which suggests that enforcement will normally occur when a driver exceeds the speed limit by a particular margin. This is normally 10 per cent over the speed limit plus 2 mph. It also sets guidelines for when it would not be appropriate to issue a fixed penalty notice but to issue a summons instead (see below). Note that these are guidelines and that a police officer has discretion to act outside of them providing he acts fairly, consistently and proportionately.

So yes, they do have the power to prosecute for 31 in a 30 but I've never actually seen this happen in 22 years of driving. Sure, plenty of people say they have been done for 31 in a 30 but I've never seen evidence for this.

I guess people say it because then they can say "I got done for 31 in a 30, it's so unfair", whereas 35 in a 30 is a fair cop and because speedometers read high, they would have obviously been speeding.
 
Before anyone asks about the speed, most counties no longer give 10% allowance as speedos are so accurate it is no longer a valid defence, also you really should be on or below the speed limit.

Well I seem to remember there's a guy on Pistonheads who was willing to give several hundred pounds to anyone who could produce an NIP like yours, so that's a bit of an incentive to look!

So far, nobody has taken him up on his offer.

Does he specifically state in the UK? :p

I got ticketed for 102 km/h in a 100 km/h zone in Melbourne. Cost me about $140 or so too!
 
I have just checked again with my missus who I thought got busted at 33mph after reading comments about the minimums, and she has corrected me by saying it was 35 she was caught at.
 
The wife for caught twice last year, not by mobile but by fixed camera. Each NIP had a link to the photo evidence of car going through the gatso. Is it different to a mobile camera then?
