360/Auction problem

I know its not strictly console related though I thought it better in here than in General.

Basically last week I committed a huge online auction 'nono', buying from someone with zero feedback, having said that the guy when i contacted him to ask a question replied fairly quickly and answered my questions.

Anyway 6 days pass by and the 360 arrives (finally), a few things are not as described:

360 premium not in original box - as stated it would be in the add, just not shown in the picture
GRAW2 (pictured and described in the add) had been replaced with some other Tom Clancy original Xbox crap which wouldn't even work on the 360.
HD cable and Network cable were missing too, not shown in add but did say usual premium accssories.

HD cable and Network cable aren't a big deal - I don't have a HD TV (though I was looking at the Hannspree 32") and got loads of network cable laying around somewhere, but I bought this particular auction because it had 2 games I wanted from the off - PES and GRAW2.

I have sent an email to the guy asking wtf is going on (no reply as yet) but was wondering if the £bay/paypal dispute thing was worth going through with if he doesn't reply, or am I just gonna have to bite the bullet and realise i made a mistake

Its a toughie, but i'd try live asap and ensure thats working incase you do decide to stick with it.

Did PES come with it? Or just the original XBOX game?

Yes PES6 came with it.

tbh I didn't get a bad deal its just the principle of the thing thats turning it a bit sour, at the minute I haven't actually seen the 360 as I'm working away, my brother is relaying info and sending me pictures of stuff.

Days pass.....and eventually the seller gets in contact

He appologises and says its gonna be in the post, though I won't hold my breath......

Things weren't as bad as what my brother told me either, I DID have the HD cable, it just had a scart adaptor stuck on the end, so after buying a 32" HD TV I'm now HD gaming

XBL works too, I have been thoroughly enjoying having my ass handed to me playing PES6 and Halo 2

So as things stand I'm still down on GRAW2, but I can live with what I have, I will file a dispute if GRAW2 doesn't arrive but i won't bet on anything coming from it.
