360/Auction problem

I know its not strictly console related though I thought it better in here than in General.

Basically last week I committed a huge online auction 'nono', buying from someone with zero feedback, having said that the guy when i contacted him to ask a question replied fairly quickly and answered my questions.

Anyway 6 days pass by and the 360 arrives (finally), a few things are not as described:

360 premium not in original box - as stated it would be in the add, just not shown in the picture
GRAW2 (pictured and described in the add) had been replaced with some other Tom Clancy original Xbox crap which wouldn't even work on the 360.
HD cable and Network cable were missing too, not shown in add but did say usual premium accssories.

HD cable and Network cable aren't a big deal - I don't have a HD TV (though I was looking at the Hannspree 32") and got loads of network cable laying around somewhere, but I bought this particular auction because it had 2 games I wanted from the off - PES and GRAW2.

I have sent an email to the guy asking wtf is going on (no reply as yet) but was wondering if the £bay/paypal dispute thing was worth going through with if he doesn't reply, or am I just gonna have to bite the bullet and realise i made a mistake

Not meaning to worry you further, but i would advise checking it on live if you've not yet done so.

If he has no feedback, sends the wrong games etc.. it could be a bricked (modified/live banned) console.

I don't wanna sound like i'm trying to worry you further, but i'd give that a try at the first chance and see if you can get on live.

If you can get on, hard drive/wireless pad is working and in good condition, i'd say its then more in the realms of keepable, but i'm sure you could get all/some money back as what you recieved did not match what you were under the impression you were buying.

Its a toughie, but i'd try live asap and ensure thats working incase you do decide to stick with it.

Did PES come with it? Or just the original XBOX game?

You can file a dispute with paypal but, thats usually if you recieved nothing, I think if you file a dispute with them stating that the item you paid for was completely unlike what was listed and the seller is not responding to contact requests they should give you back your money and i'm sure the seller will be in contact then.

Yes PES6 came with it.

tbh I didn't get a bad deal its just the principle of the thing thats turning it a bit sour, at the minute I haven't actually seen the 360 as I'm working away, my brother is relaying info and sending me pictures of stuff.

You can file a dispute if the item is "Significantly not as described", which I think this would qualify.

Also to echo what has already been said - check it on Live, chances are its banned.

It seems to be virtually impossible to buy anything high value, high demand on "that auction site" now. You can't rely on feedback because I've seen loads of scammy auctions from hijacked accounts who have 100% positive feedback. A lot of them now seem to be coming from well-spoken English people, before you could spot them a mile off with their broken English and "only acept Western Union plz contac me on [email protected]", etc.

Been trying to source a Mac Book Pro myself recently and so very nearly come a cropper bidding on items that looked totally genuine from the outside but ended up being pulled, scams, etc.

He appologises and says its gonna be in the post, though I won't hold my breath......

Things weren't as bad as what my brother told me either, I DID have the HD cable, it just had a scart adaptor stuck on the end, so after buying a 32" HD TV I'm now HD gaming

XBL works too, I have been thoroughly enjoying having my ass handed to me playing PES6 and Halo 2

So as things stand I'm still down on GRAW2, but I can live with what I have, I will file a dispute if GRAW2 doesn't arrive but i won't bet on anything coming from it.
