Thats a tricky one. I think it would be a 5870 as they are around the same performance but you could argue that the 4870x2's replacement was the 5970. I am sure you would be happy with the 5870 though and i would take no less than that as a replacement if they have no 4870x2's left.

Yep, a 5870, think of it as a good move since you can get yourself a second 5870 and beat the 4870x2 out the books.

The 5970 is much more powerful than the 4870x2 and it wouldn't be counted as a reasonable replacement, I would suggest the 5870 could be offered.

I'm in the same boat, been almost 2 months now and every time I ask for an update I'm told they haven't heard back from "their supplier". I'd be happy to get a 5870, even though it's slightly less powerful, as I'd be able to play Dragon Age at least.

I've told them I'd even accept store credit, refund, whatever... they just keep fobbing me off with this supplier malarky. TBH they need better trading partners if they can't get a reply on a simple replacement within 2 months... anything I can do legally to force this saga to a close?

good news people! i rma'd my xfx 4870x2 before christmas and have just received a brand spanking 5970 in replacement!!! cant believe it! i thought they would try to fob me off with a 5850 or something pants! there is a god lol!!!

I don't believe this.
They'd give you a replacement on market value, which would be a 5870.

Wow that's impressive! Well done on receiving that amazing card!

Hey Orangey, i too have the exact same problem as you, fobbed off many times and two months later still nothing. Is the place called Scan by any chance??

this was just a hypothetical question
just wondered what would happen

i can only advise if you do have a faulty 4870x2 that you are fully within your consumer rights to return the defective hardware within your warranty period. the manufacturer is obliged to replace the product on a like for like basis or give a full refund! i just got lucky i guess! hope you guys get the same result.

...or repair the product. the consumer can request any of the above remedies but the retailer can refuse and offer another so thats moot. either way it must be remedied within "reasonable time" this usually means 28 days. if it goes above that i'd make a fuss but to the retailer who sold the goods not the manufacturer as the manufacturer actually has no lawful responsibility, if the manufacturer refuses to repair the product for the retailer in reasonable time the retailer will have to replace, refund or rapair themeselves.

thats incase of uk by the way - dont know about other countries

i'd go to citizens advice bureau for proffesional advice, they will probably advise you to take the retailer to small claims or something similar, i think they'd agree that 2 months is not "reasonable time" providing you live in uk that is

you shouldn't of accepted either of these offers as none of them fullfills the the criteria for replacing your 4870x2! whats £180 supposed to buy you? and what use is replacing 1 card with 2 cards when you only have one pciex16 slot? no doubt you didnt put your case forward strongly enough! tut tut ocuk ripping off faithfull customers!
