5850 problem?

well got my 5850 today sapphire got it installed about 10 mins ago.
But there seems to be a problem (i think)
basicly the fan sounds like it might be catching on somthing and is making a very loud noise i dont really want to mess around with it to much as i have a touch like a blacksmith. But does and one have a clue what it is

They are pretty loud if they're wound up, you sure it's not just in a high speed setting?.

no even at 10% speed it still makes the noise

Mine does this sometimes on startup, I find pressing it down seems to silence it for a good while, but not permanently, been about a week since I last did it and it is still silent.

........... it is RMA time. I had a 4870x2 - ran OK inverted, but fan contacted casing when running the 'right way up' (different motherboards).
Unless there is packing material you can see and remove, I'd send it back without trying too hard to fix it yourself.

Supply is supposed to be easing so hopefully the wait won't be too long for its replacement.
