Thought I'd share the story of a guy I know. This happened just last week. For the purposes of the story, we'll call him John. Nothing at all to do with the fact that this is his name. :p


John goes to the local golf club for a round with some friends from work. There are two 4-balls on before them so they have to wait to get onto the tee box so they decide to have a quick drink in the clubhouse first. They play their round and each of them sets off home.

John comes to a cross roads where he has the right of way, when a woman flies out of the road on the left, right into the side of his car. Both parties were fine, but both cars needed quite serious repair. The woman immediately admitted fault, so John says he'll just take her insurance details and not to worry about it. As she writes down her details, she stops and says it was John's fault. Bemused, he says "You just admitted it was you fault, you were clearly in the wrong". She says she smells drink off him and she wants the police. John had been out the night before, and although there had been quite some time since, he feared he may fail a breathalyser test so he offers that both fix their own cars and not bring the insurance into it. Again she says she's calling the police. He then offers to fix both cars. She calls the police.

The police arrive. One cop goes with the woman to get her side of the story, and the other with John. The cop with John says that she was clearly in the wrong, as can be seen from the situation and the skid marks on the road, but because she keeps saying he had been drinking, John would have to be breathalysed. John failed the test, and the officer explains that she is now claiming to have whiplash and that she want's to prosecute, and will hit him with everything but they know she was in the wrong.

So, they arrest John and take him back to the station. Feed him and an hour later, retake the test as they can do. John passes. The two cops then offer their full support in his claim against the woman and tell him to take her to the cleaners. :)
 
Haha, result! I would have been worried to death before they did the proper breath test beforehand myself, wouldn't want to go through that stress, nice pay out in the end though.
 
For a second I thought it was a little joke, but then I thought lucky John, then I thought is this true.....

Sorry but your story is untrue or the Police were acting outside of the law. Rest time and feeding before the evidential breathalyser procedure is just not on.
 
John shouldn't be drinking and driving, admittedly people shouldn't drive into him either.

It's the law. :confused:

You are allowed to be retested an hour after your arrest.

Alcohol can hang on the breath for up to an hour, so retesting after this can give a more accurate result.
 
If that is true I'm glad the stupid woman isn't going to end up on top, but can't say I approve of the drink driving, or the Police apparently trying to get him off the drink driving charge.

As far as im aware the rest time is allocated for interview purposes and the procedure is not an interview. The custody sergeant must ensure that an evidential test is carried out in prompt time.

I can also tell you the story of a group of three friends who turned a stolen stuffed monkey into a hostage situation with the local police, and back it up with the article in the local paper this week. :p

Yes an hour after drinking, however in this case John had not consumed alcohol in the previous hour had he?
 
He may have blown under 40 and therefore allowed to leave the station without charge however the food and extra rest before the procedure just would not have happened. Why would police side with a drink driver :( You do not get the same rights as PACE dictates before interview as it IS NOT an interview. i.e. your entitlment to food etc
