Accident help

My brother has been involved in an accident (hit from behind while stopped). He wants to get the car repaired by the manufacture (car is a Mazda mps), but Aviva want to charge him £250 for not going to their approved repair centre? Is this right as I thought you had a choice of were the car went for repair?
 
Why is he even dealing with this through Aviva if the accident isnt his fault? Deal with the third parties insurer instead.
 
Has he read their terms and conditions? Tell him to have a good read and go from there.

I never understand why so few people fail to do this :confused:
 
So what he should do then is ignore what Aviva have told him and speak to the 3rd parties insurance, insisiting that's it's fixed at a Mazda dealer, or does the fact that he's already spoken to them complicate things?
 
When it's none fault you an get it repaired wherever you want.

I had someone hit my car when it was parked a few months back. Their insurers got an accident repair company to deal with it all.

They tried to play hardball and refuse to let me have it fixed where I wanted. In the end they agreed to have it fixed at the main dealer as I didn't want my paintwork guarantee affected.

In laymans terms I believe the long and short of it is, if you are not at fault you have to be put in the same position you were prior to the accident. That includes refusing the vehicle is written off (within reason) if you so wish.
 
Anyone care to suggest an insurance company that will authorise repairs at the manufacturer without penalty? I'm with Tesco and have recently read that they will only pay for a courtesy car if you use their authorised repairer (who were Just Car Clinic last time I checked).

Most have that clause but often your choice of repairer will give you a car anyway just to get your business.
