Advice re: parking ticket

Last week I got a parking ticket from City of Westminster for "stopped on a pedestrian crossing/zig zag area". Heres a lovely diagram of the area and my car (red with X):

Would this count as being "stopped on pedestrian crossing/Zig zag area?

The hatched area me and others were parked on is frequently used when there are no residents bays available and on this occasion only I got a ticket - presumably because my car is at the level of the zig zags but the others weren't.

Sorry if this sounds like a stupid question but does the fact that my car was outside the zig zag area as opposed to inside (i.e. not on the road) mean that the PCN may be invalid?

Look carefully at the photo and you can see where the zig zags end. Miles away from the crossing, which is the reason I didn't even pay attention.

Any advice appreciated,

Simply put, yes you are in an area you are not allowed to park in.

Also technically so are the other drivers, but you very much so are in the wrong, as far as I can see as you are level with them zigzags...where you just don't park :p

Yup, looks like it's a valid ticket to me. One thing though - I though parking on zigzags was a 3 point penalty too? I assume you've only got a fine though? Or am I barking up the wrong lampost there?
 
It's an interesting question.

While I would initially think that parking on cross hatched area would invite a ticket it seems not considering the other cars were not penalised.

Following on from that I'm not sure exactly how you are guilty of parking in the zigzag area. You are not actually on the carriageway covered by the zigzag.

I'm sure someone less tipsy than me can trawl through the relevant legislation :o

I've only got a fine, just a regular parking PCN, contravention code 99, for being stopped on a pedestrian crossing/zig zag area.

I'm certainly not stopped on a crossing, in fact the crossing is a good 15-20 metres away, but my question is, is the zig zag area the area outside the zig zags as well as within them?

I wouldn't have questioned it if the contravention code was referring to parking on a hatched area, however I've parked alongside the residents in this cross hatched area for years when visiting my sister (as most of the time the parking bays are full), and there never has been any issue with tickets.

In fact I don't understand why this area exists at all, its huge, around 40m long and around 5m wide - wide enough that the length of my car does not overhang onto the painted zig zags themselves.

I've looked round the net to see if parking outside the zig zag area (as opposed to inside it) is allowed but it seems impossible to find any such info.

I've also posted about this on a parking forum but no one's replied.

After all, its not uncommon for there to be a narrow pavement with a shop front or wall directly outside the zig zags in many crossings. When I parked up I didn't think at all of the crossing as its so far down the road. I just pulled up and parked like I usually do :mad:

I am going to contest this one but any further info appreciated!

my brother was in his first 6 months of passing his test and got 3 points for speeding

the same police officer had pulled him 30+ times in 2 months she pulled him the last time and his back wheel was on a zig zag lines so he got another 3 points and his licence took off him


the copper had asked him to go out for drink every time she pulled him too

think yourself lucky its just a fine

I understand what you're saying mate but theres a chance I shouldn't have been ticketed at all - I'm not parked on the zig zag!

IIRC it's anywhere between the zigzag as well, which ends at just before the end of you car, which is why no one else got a ticket.
 
From the Highway code

109: Areas of white diagonal stripes or chevrons painted on the road. These are to separate traffic lanes or to protect traffic turning right.

If the area is bordered by a broken white line, you should not enter the area unless it is necessary and you can see that it is safe to do so.
If the area is marked with diagonal stripes and bordered by solid white lines, you should not enter it except in an emergency.
If the area is marked with chevrons and bordered by solid white lines you MUST NOT enter it except in an emergency.
Laws MT(E&W)R regs 5,9,10 & 16, MT(S)R regs 4,8,9 & 14, RTA sect 36 & TSRGD 10(1)

Interpreting the bold text, you should consider yourself lucky that you only got a non-endorsable parking ticket. You could possibly be done for leaving your vehicle in a dangerous place.

If you appeal and lose, they might start issuing tickets and fines to everyone who parks in the hatched area.

I'm no legal expert, but let's say he disputes and wins.
Doesn't that leave the door open for the council to then issue a ticket for leaving his vehicle in a dangerous place? I believe that traffic wardens are empowered to do so.

so your brother is either

1. failed master criminal

2. suing the police for harassment

3. "Is it cos I is black?"

The wardens have to issue the ticket at the time of the offence for it to be valid. Think a copper might be able to issue it though, not sure.

Although i haven't seen a traffic warden in months down here, we've got council scum dishing out the fines now.

Well if thats how he drives I'm glad he doesn't have a license any more.
