Right forumites...
got a real problem here, my daughter has just come home from school in tears -- her 8 day old mobile phone which cost £180 was confiscated from her during a lesson (she was not using it)

teacher saw it in her pencil case and took it off her

the story now gets very interesting here... dumbo teacher leaves the phone on the desk in the classroom and lo and behold someone has stolen it from teachers desk
the camera was in his custody - and as such I believe that he should pay for it
to say I am furious is an understatement... how the hell can he lose someones personal property, his advice to my daughter was to call the police

well I believe he is the one that should have been calling the police and I cannot see how they cannot be Liable to replace the phone

my wife is going to school tomorrow to see the people concerned... but would welcome all thoughts about how we approach this

obviously time scale is short so all advice please

You gave a £200 phone to a school kid? Why on earth?

As for the problem at hand, I'm not sure how far you'll get. Normally they'll say property brought on site is the child/parent/teachers responsibility, but as it was confiscated you might have a chance I guess.

Wait and see what the school say and take it from there, it might not turn out that painful.
 
It was on school grounds therefore it should fall under the responsibility of the school, probably worth getting in touch with the headmaster/headmistress.
 
Speak with the school first. They will have rulkes about taking mobiles to school.

I won't try and lecture you about sending your kid to school with a £180 phone, but don't be surprised if someone else does.
 
Sorry Chris, that was my initial reaction as well, a cheap £10 Nokia should suffice, why did you feel the need to spend nearly £200 on a phone for a young kid? Very foolish imo

Back on track, Otacon pretty much summed it up for me. The teacher had already confiscated it... might have a chance of getting some money back, but you can never be sure

My advice would be as calmly and sensibly as possible. For example regarding why it was confiscated....on matters like this there is often a 'difference of perspectives'...

If someone has stolen it from the teacher's desk I'd expect the school to cough up as it was in their safe-keeping, but going in all guns blazing in a a rage demanding a refund will in all likelihood lead to them clamming up and being as awkward as possible, saying that she shouldn't have had it anyway, it's against school policy and suchlike.

Find out what the exact story is first then sort out a reasonable compromise, a quick call to the police to get a crime number then a claim on either your house insurance or the school's insurance should resolve the issue I would have thought.

Agreed, I would have bought a £10 phone if it was being taken to school.
But the fact she was not actualy using the phone, and the teacher lost it - I would be pretty damn angry and certainly ask for my money back.

I did not know she had it with her at school, and regardless of why it was confiscated by the teacher... I would think it's common sense that they are liable as it was in the care of the school when it was stolen

I have no doubt at all that we will never see the phone again, but all we can do is see what they say tomorrow

I imagine they will tell us to ring the Police,
