It's an established legal precedent that not only can a person declare their physiology to be different to what it really is but they can also make that declaration retroactive and they can use the state to force people to obey them in their pretence. Reality is officially irrelevant. This ruling makes the law inconsistent with itself. That's not entirely common sense.

I would disagree. Age and physiology are different. Had he wished to be identified as a old woman instead of an old man he might have won or indeed not even needed to go to court in the first place. The dutch are quite an enlightened lot in my experience.

I have and feel I summed it up above. They only ruled against it because it made things confusing from a legal sense.

The only distinction made was that it would be difficult and, most importantly, not enough people with enough power want it. That's not a fundamental difference, merely a political one.

Apparently his physiology is consistent with the age he wanted to be declared to be. So he has a far better case than people who declare that their physiology is different to what it is.
