Surprised there isn't a thread on this, seems the only mentions were in the Derek Chauvin thread.

So we are already past day 3. Not looking good for the defendants so far. Their defence of they were trying to make a citizens arrest doesn't match their statements to officers at the scene. None of them mentioned that was their intent at the time.

The owner of the property that Arbery had looked around told police he didn't believe Arbery had taken anything and the prosecution said he was just having a "looke-lo" as do a lot of people on construction sites.

Looking like it could be a good old fashioned southern lynching. Hopefully justice will be served.

What I find surprising (not) is all the comments in the Chauvin thread about this case from the usual suspects deuse, the running man but have all gone silent since more came out about the case. Now all they seem interested in is the Rittenhouse case.

I just did a quick search with my user ID and his name and I could find one post - it was a request that you use another thread, not calling you dishonest here but what posts are you referring to in the quote above? Maybe I have mentioned it somewhere but it isn't apparent from a search?

You never fail to disappoint. How would you expect his family to describe him? He isn't a murderer, he doesn't fiddle with kids. He is a kid who went for a run, was maybe nosy and paid with his life for that and being black in the wrong neighbourhood.

Weapons charge in the US could mean anything. And as for shoplifting, please that is something so many young people do, sometimes for the thrill, sometimes as a stupid dare. It is such a minor crime and means next to nothing about a person. We all did stupid stuff when we were young.

Its different in the US, in the UK the police can search your car and they don't probable cause. In the US there has to be a reason, they have to suspect you or a crime. So maybe the search was illegal and he was simply standing up for his rights.

All of that is irrelevant though. Those 3 men didn't know any of that. They saw a young black man in their neighbourhood and decided to arm themselves and then chase him down. When cornered he attempted to get the gun off the man closest to him who was pointing that gun at him and he was shot 3 times. He no doubt was in fear of his life, he had every reason to be so. He is a black man in Georgia and 3 white men are attacking him. History says he should be scared. Events after the killing proved that institutional racism is still alive and kicking and if it hadn't been for the video getting out those 3 men would be sat at home drinking a beer, at least one of them laughing at the (n-word) he killed and got away with.

Why wouldn't he be? You could say the same of the killers father as he didn't pull the trigger either. Felony murder is one of the charges and could be charged to every person who took part in a crime where someone was killed/murdered regardless of whether those people took part in the actual killing or not or a killing was ever planned. So a robbery where someone died, every one who took part could be charged with felony murder.

He did cooperate with police though so if convicted he might get a more lenient sentence. At least he appears to have shown some remorse.

COUNTS 2, 3, 4 AND 5

Felony murder
This charge applies when a death is caused in the course of committing another felony, “irrespective of malice” — in other words, whether or not the killing was intentional and unprovoked.

defines this crime is as an assault using a deadly weapon. This count charges the three men with attacking Mr. Arbery with a 12-gauge shotgun. It is punishable by imprisonment of one to 20 years.

COUNT 7

Aggravated assault
Another way Georgia law defines this crime is as an assault using “any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury.” This count charges the defendants with using two pickup trucks to assault Mr. Arbery. It is punishable by imprisonment of one to 20 years.

COUNT 8

False imprisonment
This charge applies when a person without legal authority “arrests, confines, or detains” another person “in violation of the personal liberty” of that person. Specifically, the defendants are charged with using their pickup trucks to chase, confine and detain Mr. Arbery “without legal authority.”

False imprisonment is punishable by one to 10 years in prison.

COUNT 9

Criminal attempt to commit a felony
Georgia law defines criminal attempt as performing “any act which constitutes a substantial step” toward the intentional commission of a crime — in this case, the false imprisonment charged in Count 8. A defendant can be convicted either of completing a particular crime or of attempting it, but not both.

Because false imprisonment is a felony, attempting it is also a felony, punishable by half the attempted crime’s maximum sentence: in this case, one to five years in prison.
 
You seem to have failed at reading what I've written. What actions did he take. Not what is he charged with.

It says in those charges why they are relevant. Did you even read it?

@Energize why weren't those guys that filmed George Floyd prosecuted then? They were lauded as heroes. It makes no sense.

What a ridiculous thing to say. They were witnesses to a crime, they were also begging him to stop so they clearly didn't partake in it. If another officer had stood and filmed it that would be partaking in the crime. In this case he decided to get in his vehicle and take part in the chase.

These are the charges he would be most worried about. Although if the others are found guilty of felony murder he could easily be found guilty of that as well. I still think the court will treat him more leniently because of his cooperation and remorse.

I'm the last person to play the race card, but it admittedly looks like a modern day lynching.

Not only that but the subsequent cover up and failure to actually attempt to get justice for his family show that racism is still built in to the system there. I do wonder if 3 black men had chased down and killed a white man while he was just out jogging would the police and DA have just swept it under the rug? Would they hell.

I said I'm dyslexic. I have to read things several times because my brain sees words as other words. Mixing up words letters I'm constantly reading a word as another word because it looks similar. Also without spell check my posts spelling would be horrific.

Again though its says in what has been posted what he did and why he was charged because of those actions.
 
Probably that, as this thread is just 24hrs old vs the 15 months old Rittenhouse thread yet doesn't have the same number of replies, GD must therefore be full of racists - as a guess anyway, although I know I'm probably being unfairly harsh with my bias towards Klinck.

Regarding the case it's a right mess and I suspect the defendents will be found not guilty of murder even if I disagree with that in most regards, but found guilty of a lesser charge. To me and my understanding of events (could be wrong TBF) -

1. Seeing someone trespassing in an area which has suffered from B&E and then seeing the "suspect" running away so deciding to give chase in you car - not illegal but debateable in reality.

2. Attempting to perform a citizens arrest whilst you are armed - not illegal but, to me, a bad decision for many, many reasons. Mainly that you have no idea how the "arrested" will react etc.

3. Getting into a fight with the "suspect" so you shoot him - could be classed as self-defense but there were many other options available rather than getting into a fight which should have been avoided at all costs.

Then you have the reverse -

1. Out for a jog and you pop over to a house being built (IIRC) to have a look through the door - trespassing but a tiny thing.

2. Carry on jogging and suddenly a truck with 3 angry, armed men jump out shouting and pointing their guns at you so you, understandably, feel threatened - a fairly normal human reaction.

3. One of the guys tries to grab you so, fearing for your life you fight back but get shot and die.

Both sides "could" claim self defense, but the aggressor (to me) is the guy who tried to grab the jogger as there were many other non-violent ways the guy could have been "stopped", even just driving beside him whilst on the phone with the police etc (or any other scenario) so I would think that a jury will decide that his actions led to the shooting, hence a conviction on a lesser charge.

3 armed angry men in two trucks, one of which has a confederate flag on it. If I was black and in the south and saw that I'd feel more than just threatened, I'd be in fear of my life.

And I only made it because no one else had. It is another big case, not just because 3 white men "lynched" someone but the police and DA then buried it and if the video hadn't leaked it would never have resulted in arrests let alone a court room. That tells you something about justice in Georgia.

But what was he doing to get those charges.

You claim to be American. You can read English right? It says why he was charged in the charges listed in the thread. Its been explained by more than just me already. Go figure it out.

Well a lot of people were caught on camera being nosy around that site so clearly people in America do indeed look around building sites that are not fenced off. But because this guy is black he must be looking to rob it right, even though the owner said from the footage he made no attempt to take anything or look like he was looking for things to take. Do you even attempt to disguise your bigotry or are you just happy to lay it bare for all to see? You seem to wear it like a badge of honour.

Oh and from an earlier post of yours. The idea that the confederate flag isn't a fog horn of a dog whistle is laughable. It is a symbol of a racist history that is still present in 2021.
 
This is a pretty open and shut case though. That would be why I would assume it doesn't have as much traction as the other case, OP.

Personally I'd just ignore the serial OCUK race baiter and just get on with life. There's a lot of very good people on here, don't bother winding yourself up over a massive minority of the forum

Derek Chauvin was pretty much an open and shut case. You only needed to watch the video of him slowly murder than man over 9 minutes to know he was guilty. Yet that thread was how many pages? And how many posters were claiming it was a sham, the judge should throw it out the case was that weak, the prosecution hadn't proven anything, he was scum he had it coming etc etc.
 
100% agree with that statement, unfortunately it seems to be the default "go to" insinuation when a Black person is attacked by a White person, irrespective of how factual accurate it is, but it's almost never the default when a Black person attacks a White person, as if racism only goes one way for some folks.



Why do you think this case is "clearly" racism? Were the attackers heard on video using the N-Word, or shouting racial abuse at the kid, or have a history of racist speech/online hate etc? I don't know if the insinuation is based on something you've heard them say in the video or seen posted afterwards or is it just based on them being Southern and having a Confederate flag IDK?

Well there is the fact that after he was killed this was said

“Mr. Bryan said that after the shooting took place before police arrival, while Mr. Arbery was on the ground, that he heard Travis McMichael make the statement: ******* *n-word” Dial said in testimony.

Now I'm going to infer from that that race was definitely involved in this.

People are so socially conditioned to see the bogeyman of racism where there isn't any these days that they'll jump on any little thing to confirm their biases.

So you don't think this case is about racism? The killing and the cover up that followed?
